Hello, I intend to submit my defence today can someone inform me if I also send my costs schedule with the defence or is that done later?
Do it a few days before the hearing, or with the Witness Statement, usually to be submitted 14 days before the hearing. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hello all,
Just wanted to update. Defense was sent to both court and excel. Court have confirmed they've recieved papers. Noted that excel don't accept defense by email so posted as well as emailing.
Worried now as I sent it special delivery; if that needs signed for can't they just refuse to sign for it and claim they were never served defense?
Wondering if I should chase this up now or forwarn the court and say I sent this a week ago but still haven't heard anything from them, they may be attempting to get a default judgement against me again?
Thoughts/options/next steps?0 -
Will SD not note on the tracking that delivery was refused? But 1st class with a certificate of posting is the way to do it - that way they have to prove they DIDN'T receive it..0

Yes they can.Worried now as I sent it special delivery; if that needs signed for can't they just refuse to sign for it and claim they were never served defense?
Have you checked the Special Delivery tracking information?
Was it delivered or not?
And there is no letter 's' in defence.0 -
Have already checked it's been signed for.
How long can I expect this to go on for? At what point can I reasonably expect them to drop this and stop making my life miserable? It seems unfair that no timeframe as been imposed on them for then deciding to take this to court? Can they just sit on this as long as they want then decide to bring it to trial months later again without my knowledge (if I were to move again for example?).0 -
It's now in the hands of the court. The Claimant has no further control. It should (subject to how busy the local court you've nominated is) take about 6-8 weeks to get to the hearing stage. Can they just sit on this as long as they want then decide to bring it to trial months later again without my knowledge (if I were to move again for example?).
If you move, write to the court, the PPC and their solicitors and inform them of your new address 'for service' (use that term as it has specific meaning). Please note, we are not a legal advice forum. It will take quite simply as long as it takes.0

They are not going to drop it! You need to read about hearings and get ready.
At what point have the Newcastle court said you need to file & serve your EVIDENCE?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
