New generation parking charge for not using facilities

  • What about of the lack of photo evidence? The company claim the driver did not use facilities but the only picture included in the NTC just shows the back of the car. No further images have been supplied or are posted on there website when the owner enters the parking charge number.

    when the KEEPER (not OWNER) enters the NTK pcn , not NTC) details on the website (ownership is a different ball game)

    only a judge can decide that issue you complain about above when ALL of their evidence is given to the court (which you SAR beforehand and you put their witness to the test by tring to quiz them in court)

    parking companies monitor vehicular movements on a private site, so making their charge "stick" on this one may prove a lot harder, but they can and do try it on anyway, as if they are allowed to monitor the movement of people as well as vehicles

    argue it to popla or to a court , not to this forum, we are well aware of their tricks

    You can send the PPC a SAR asking for all personal information relating to you and the VRM of your vehicle. Ask that photographic evidence of the driver leaving the site is produced.

  • The forum being aware of their tricks is what I was counting on, hence the post. I am not aware of the type of cameras they may use in a small car park. If it was just a guy taking a picture with a hand held camera of a parked car then this would not stand up in court. However if they use CCTV and are allowed to to film a person and present this in court then that would strengthen a case if the alleged breach of contract occurred. I have heard about SAR before but this would be requested much further down the line if required. Like you said early it’s a lot of hassle back and forth to fight the charge and get them to play their hand but this what they rely on I guess and why they offer a heavy early discount on the charge if paid in 7 days.

    Just send the SAR. Or if you’re so worried about it going up to £60 just pay them. Sitting on the fence won’t get rid of this for you.

    I have heard about SAR before but this would be requested much further down the line if required.
    Why? Do it now. You will soon be reassured that they have no CCTV, no evidence.
