New generation parking charge for not using facilities

Hi,
Owner received a parking charge notice for not using the facilities in a small car park. After further inspection the car park has a notice which states the usual stuff about being a car park for customers only (does not name any shops though) and states that you must not leave the car park on foot if you intend to use the facilities upon your return. The owner has now received £100 charge, reduced to £35 if Paid in 7 days (2 days to go). The issue is the picture of said car clearly shows empty parking bays next to the car and Driver states they returned and left the car park in about 25 mins so did not exceed the 30 mins allowed as per signage. Owner would therefore argue that the £100 charge for 25 mins parking is not proportional or a fair estimate of damages to the land owner as there were clearly spare parking spots as seen in the picture they sent car owner. Driver also used the Dominos website to look for lunchtime pizza offers before getting out of the car so In theory has used the facilities even though no order was placed. Owner would also argue that a picture of the car is not proof that The driver did not use facilities.
Looking for advice, should The £35 be paid or Is there enough to fight this?
Owner Really need answers within 24 hours if possible.

Edit your post to remove all information about who parked, who drove, and who may or may not have left the site.
Do this before you do anything else!
Only ever refer to The Driver and The Keeper, who are two different people.

Your opening post still needs hasty amendment.
As Fruitcake said, the driver and keeper are two different people.
It was the driver who parked and didn't see the small signs.
It was the keeper that received the PCN.
It was the keeper that is now looking for advice.
And this sentence is just plain ridiculous:The driver always parked here and nips over the road to get xxx hair cut?

I have now read newbie page. Template doesn't mention anything for an appeal against 'not using facilities' was wondering if anyone else had been in a similar situation and if they were successful at appeal for this reason? From what I have read online not many appeals are successful in these sorts of cases.0

You've probably also read that some PPCs don't even bother to read the detail of appeals.
Some PPCs will recognise the MSE forums template and put the appeal in the 'too difficult' pile.
Send the already written for you blue text template appeal unchanged - no additions or alterations necessary.
Send it as the keeper.0 -
Ok thanks will give it a go. Parking charge will increase from £35 to £60 if they choose to proceed, so that was my only issue.0
