I've won a few at POPLA and I've somehow managed to keep VCS at bay but this is the first time I've been to court. Would I do it again for someone else? Yes.
Roll up, roll up. Get your Lay Rep here! :D
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well done "whiskey" - yes please...

Well done all of you. I admire your relentless effort for such a worthy cause.

I assume this Ms Jackson came from Elms Legal. It's a shame that these rookie legals have to cut their teeth on a scam
  • I'm not sure where she was from. She was perhaps late 50s. I guessed that she might be in the twilight of her career although people can retrain at any age.
The whole thing is, without doubt, a scam. My aunt said to me that if she knew that she hadn't entered her VRN then she would have paid it.

    Yay, well done!

What a dreadful Judge though. The three points (and there were three) namely:
    (a) the POFA,
    (b) the CRA and
    (c) the Beavis case paras 98, 193 and 198

...mean that even if the added £60 is on a sign, it is still DOUBLE RECOVERY and they cannot have it.

He is right it's not unusual, because the PPCs (apart from ParkingEye) operate in a cartel-like fashion, egged on by both the BPA and IPC, and routinely get away with adding sixty quid that is actually unlawful.

And it is Judges like him that wrongly allow it, and need to read the 3 areas of law and case law that scream 'THIS IS DOUBLE RECOVERY'!

ANOTHER ONE BITES THE DUST - well done!

And if you are serious that you'd do it again as a lay rep, as I do in the Sussex area, then I am pleased to point people in your direction if they have a Stoke area hearing.

Even if you can just chat to them by email it all helps.
