  • Hi Woody. Have done that. She sent a response but due to strict parliamentary protocol is unable to support my aunt because she is outside of the constituency. Sue is keeping us informed on the group legal action against HX

    I also have a letter from my aunt's neurosurgeon outlining the detrimental impact that this is having on her condition. Glads requested it to compare with the Equalities act but issued a claim before it reached us, so I'm unsure what to do with the letter now.
    Email it to them anyway (as Auntie) and tell Gladstones that the evidence of faulty machines is overwhelming and people are now angry and fed up with HX's machines routinely recording two digits by default, and as she is disabled, the D is going to Counter claim for £500 and here is the letter they asked for in the pre-action phase, before they prematurely issued a claim anyway.

    Give them seven days to discontinue, or the case will be defended AND counter-claimed for breaches of the Protection from Harassment Act, and the Equality Act 2010, and for clear & obvious data misuse under the DPA 2018 & the GDPR and - last but not least - unfair terms (breach of the Consumer Rights Act 2015) due to HX's faulty machines causing this obvious scam, which Auntie is also reporting to Action Fraud.

    We'll help you write the counter claim.

    I hope they will discontinue before she needs to defend/counter claim.

    I still have the pictures of my ticket and one from another person where the machine wouldn't put a reg in if you nrrf any extra evidence at all.
  • Hi Coupon Mad- thanks for that. Wow- have they possibly made those breaches then?
    I'm sending the letter by post as I don't have an email for Glads.
    Do I write it pretty much like that or provide further details of how the breaches occurred? I'm not very familiar with all those laws.

    And thanks Woody. I got a recent image yesterday from someone who lives nearby. It seems they have added stickers to all their machines. Nice.

    It's the Parkeon machines they're using that's the problem the programme on channel 5 showed a car park in Basildon using the exact same machines as HX use and it does the samd there as well.

    Thank you for your recent correspondence. Please find attached a copy of the letter from the defendant's consultant Mr Xxxxx which you requested in the pre-action phase before a claim was prematurely issued anyway.

    The evidence of the machines used by your client being faulty is overwhelming and people are now angry and fed up with HX's machines routinely recording two digits by default.

    The action your client is taking is unreasonable, entirely without merit and punitive and is having a significant detrimental effect on the health of the defendant. So much so that her medication has had to be increased.

    The defendant requests your client to discontinue within 7 days or the case will be defended.

    The defendant also reserves the right to issue a counter claim for £500 for breaches of the Protection from Harassment Act 1997 and The Equality Act 2010 and for clear and obvious data misuse under the DPA 2018 and the GDPR and for breach of the Consumer Rights Act 2015 due to HX's faulty machines which will also be reported to Action Fraud.

  • Gallstones sent a letter to my aunt today. Something about the hearing on papers? I'll get to see it tomorrow. I'm assuming that we say no and request a hearing so that they have to send a representative? I want to be there anyway- for my aunt.
