Fistral Beach Car Park (Initial Parking) - Newbie template wins!

Hi guys


Appologies for starting a new thread (cant post links either)
I have had a look through the newbies section and a few threads that I think relate to my case.


As a summary, the carpark was packed and spent the whole time there looking for a space to open, got frustrated and eventually went to another beach



Im at the point of making my appeal and just want to make sure I'm on the right track. Im aware of not giving driver details.



From what I've read I think I have a golden ticket as NTK arrived 18 days after the charge and no mention of POFA

On the Initial Parking website appeals page the dropdown is confusing me a bit too, I feel they are being sneaky and not giving many choices, please advise.

    If you did not park you did notr enter into a contract, therefore there can be no breach of contract, read this

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    One of those images shows a sentence highlighted that gives away the driver's identity. This would blow a golden ticket out the water.

    Look for an option such as "Other".

    The Fistral area shows car parks operated by Smart, Parking Lie, Euro Car Parks, CRAPCOA, Headland Hotel, Morrisons, and the local Council.

    I cannot find a single mention of Initial Parking operating in the area.

    OP, please confirm the area where the alleged event took place.

    Wow thank you for all the replies guys!

    Part of the reason I decided to make a new post was because I couldn't really find anything on Initial Parking at Fistral beach in any of the more recent posts. Then on the appeals page, it felt like they are trying to catch you out by only giving those set options...

    If there is no online option that doesn't reveal the driver's identity, then send a postal appeal as it gives you that option on the NTK.

    What the heck are a nonentity firm like 'Initial Parking' doing at Fistral Beach?

    Were Smart kicked out?

    Is there really no 'OTHER' option as I really don't recommend a postal appeal.

    What about the last option: 'THERE WAS NO SIGNAGE'?

    That choice looks like the one I'd use (it will be wrong but does no damage!). It might also get a reply that shows us the signs there.

    Fascinated to see a new kid on the block (beach) get beaten at POPLA!

    I can't find any reference to IP at Fistral, but there over a dozen car parks around the area so it is possible they have sneaked into one somewhere. Perhaps the OP could be more specific as to the location of the car park and landowner.

    The NTK is non POFA compliant so should be an easy win at PoPLA. The scammers also tell lies in their NTK. Imagine my surprise.

    Get your own pics of the site and signs if possible.

    Without seeing the online appeals portal I can't comment on what's available, but the NTK definitely allows a postal appeal. If there is no other option then that should be done by sending it first class from a Post Office counter, and obtaining a free proof of postage.
