Ukcps MCOL

So today i received a county court MCOL.
I was issued the pcn September 2018, I have just ignored everything they have sent me.
After receiving the MCOL today i drove to the car park in question and it now displays signs for a different company "Parking control solutions" .
I`m more than happy to have my day in court to face these people but I`m wondering if anyone has any advice on filling in my defendants report.
Background story: I`m a blue badge holder who is undergoing Heart transplant assessment,
I visited the place in question to pick up a prescription, I drove around the car park 3 times waiting on a free bay but none became available, So like i would in any situation i looked for where i would cause the least disruption and parked on the double yellows which my badge allows on roads in my home town. i was in the pharmacy about 5-10 minutes then i drove home.
I received the pcn through the post just a picture of the back of my car, i have since ignored letters and bailiff letters.
Any advice will be greatly appreciated thank you.

    What is the Issue Date on your Claim Form?

    Did it come from the County Court Business Centre in Northampton, or from somewhere else?

    email a SAR to the DPO at UKCPS and get all their data on your vehicle


    when you say that the driver parked on "double yellows" , was this on a public road or on the private car park ?


    if you have read your blue booklet you would know that the BB doesnt help you on private property, which is why I ask the question


    so NO you cannot use it on private property to park on yellow lines , whereas you can on public roads


    it is not clear on what the actual contravention was that they are suing you for


    ie:- its either being incorrectly parked on private property , or not following the parking rules on private property , so we need further clarification as to what the alleged transgression was


    meanwhile , read the NEWBIES FAQ sticky thread, post #2 , and login to MCOL and do the AOS online , asap


    then do the SAR by email


    then start drafting your defence

    With a Claim Issue Date of 3rd May, you have until Wednesday 22nd May to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Wednesday 5th June 2019 to file your Defence.

    That's a whole month away. Loads of time to produce a perfect Defence, but don't leave it to the last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Not really. It is easier than you think and even doing the defence is mainly copying.

    Emailing a SAR is shown in the NEWBIES thread (easy - template right there!) as is acknowledging a claim online (even easier - pictorial screenshots right there!).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Step 1 Complete i have submitted my AOS.
    I have been down to the car park in question to take photographs of the entrance to prove lack of signage, There is no signage at the entrance or on the main car park sign the only signage is for a completely different company now so i think they may have lost the contract or have changed the name.
    The new company is called parking control solutions.
    Also i have looked on the UKCPS website and google and i can`t find an email address to send my SAR to the only address is postal. Does anyone happen to know the email address?

    check GSV for pictures and use the historical option to go back in time , hopefully there will be pics you can download and use


    I can only find the postal address on their privacy page

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
