Parking ticket, photo of my number plate but DEFINITELY not me!!

Hi everybody,

I received a parking ticket this afternoon for a place I have never been, at a time where I was definitely, unmistakably at home, snoozing away in bed.

There is a photo, it is my number plate, but I cannot clearly see the vehicle as it is so dark. All I know is that it definitely is NOT me and my car was parked outside my house all evening. Nobody else has access to my vehicle regardless.

What can I do?! I am panicking as my first guess was that somebody has cloned my plates. The car park in question is not that far from me, but I have never been to that place before.

The company is Minister Baywatch.

Any advice?!

    The exhibited number plates are computer generated representations. They are a result of ANPR camera taken shots of the vehicle entering and exiting the car park, focusing on the number plate. From ANPR photos taken in the dark, it’s always difficult to see the shape/make of the vehicle shown on the Notice to Keeper.

    The likelihood is that there’s been a misread of the VRM, either by the camera or an operator entering the number into their computer system. It is highly unlikely (although not impossible) that this is a cloned plates case.

    How far away are you from the location of the car park where the alleged contravention took place?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    About 9 miles, but I have never been to that town in my life.

    The photos clearly show my number plate, I can't see that it has misread this. I cannot see if it's the same car as mine as the photo was taken at 9.30pm, then again at 5am. It is too dark in both photos.

    Thank you for this - I am not one to put things off. Extremely angry this is happening, as I have enough stress at the moment without random parking tickets!

    One issue - it says to appeal stating where I was at the time and proof of this. I don't really have any proof that I was sitting at home. How do I get around this?

    That's not the main thing to do at all. The other advice there is FAR more important.

    Appeal is the least important thing, but you could just say you have reported the matter to the Police & DVLA as this is not your car.

    NOT 'this was not ME'.

    The DVLA will sort it.

    So should I be reporting this to the police, or just the DVLA for the time being?

    And I hope you don't mind me asking, as I just want to make sure I'm doing everything right....

    In regards to

    "(a) send the Parking firm (NOT PCS) a Subject Access Request asking for all photos; attach proof that you are the data subject for the car they wrongly allege was there (i.e. a scan of your V5C). -

    Would I send this email to Minster Baywatch who are the ones I received the invoice from? When I email them, do I explain the situation as well as request the photos?

    a court case, for the same company , same location

    perhaps its a misread, perhaps its a clone issue , but ideally you get on with it now and dont await court papers

    the SAR goes by email to MINSTER to their DPO , asap (no letters) with a V5C picture atatched

    and the request to the DVLA goes direct to them by email, although their reply will be posted within 30 days or so

    You could/should also send a pointed letter the Mecca bingo saying that their agents have accessed your personal data without just cause
