Hi all.

Lucky me, this morning I received a PCN from NPS stating I owe them £100 (£60 if paid in 14 days) as my car allegedly used one of their car parks for 8 minutes.

Apparently this car park was free for patrons of a restaurant only I received something similar years ago with Parking Eye and won an appeal through POPLA.

i had a quick look through the newbies thread to refresh my mind. It seems that NPS are a BPA member, am I right in thinking that I send the "ONE SIZE FITS ALL that doesn't state who was driving" first appeal that is blue in that thread?

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

    - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

    We can't have people all starting threads repeating the template appeal.

    It's there to stop threads drowning us. Sound harsh? Far from it! Be in our shoes.

    You will be glad we are this strict when you really need help, when you've drafted a POPLA appeal later. At the moment there is no need for a thread or replies, this stage is standard and we can't do this one by one.

    They are obviously trying to scam you so complain to your MP.

    Parliament is well aware of the MO of these private parking companies and on 15th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    You say there's to be no admission of who was driving!

    You need to edit your post to remove details of who was driving

    The ppcs monitor this forum and can use posts in your thread against you in court

    I will send that appeal to them now then and will update when I receive the inevitable rejection.

    As for complaining to the MP, I never thought of that, I will look into doing so, thanks!

    Hi all, I have received a rejection letter for the appeal today along with a POPLA code. The letter also states that my appeal was a "much seen internet template which is wrong on more that one point" (yes the "that" is actually wrote on the letter)

    So what is next now? I have been reading through the sticky threads and searching for NPS POPLA, but I am still not sure how to begin wording this appeal.

    You won't find an NPS POPLA appeal. They aren't bespoke for each individual company. POPLA appeals are a broad range of points.

    As advised follow some examples linked in post 3 of the Newbies thread.
