This is a Vent, not going to name and shame just yet, they have one last chance, wondered if anyone else had experienced this. I went into a well known large builders merchants last week, made quite a big order, which was due for delivery this Monday. Went back in on Saturday last week, desided to collect one of the smaller items, save waiting for the Monday, well, guess what inspite of me paying for the good last week, when we went to collect them, THEY HAD ACTUALLY SOLD THEM SO SOMEONE ELSE. Was absolutely livid, even more so by their atitude. So, we cancelled the whole order. Rang Consumer Helpline at CAB, who said well, they have given you a resolution, because they have given you a refund. Hubby said they should contact seond party tell them the goods were already ours because we had paid for them, what do you think?

sale is concluded at rime of dispatch , "your*" products could have been display products , and the order was being fulfilled and delivered from another depot

Id imagine a lot of builders merchants use just in time supply. Was the product you requested on order for monday?
There no benefit to business of the resolution your husband is offering. Theyll only be upsetting another customer and in the meantime youll have already been effected by your upset.

what it the item that is so unique that you want to retrieve it from the other buyer?
They were originally going to deliver your item(s) and presumably would have done so. Until the point of despatch the goods still belong to the merchant.
I'm struggling to understand why this is a problem? They have refunded your money.
But perhaps you could help by explaining what the item is?0 -

I'm just reading through this again and I really not getting it.
You placed the order and they said they would deliver it on an agreed date
You went back and said "actually I'd like to collect some of it now", but the goods were no longer in stock [presumably "your" order would be fulfilled from a delivery or another branch]
You complained (not sure what about) and cancelled the order
They refunded your money

Sometimes, when I put in my online grocery order, by the time delivery date comes along, they have sold out of an item. Makes me livid to think that someone else is enjoying my tin of beans...... Jeez.0

And if you went in a few days before your order was due to be delivered and saw no beans on the shelf, would you then cancel the entire order ?0 -

They had an obligation to meet your order the following week, not the day you arbitrarily popped in and expected one item to be instantly available to you.
To be blunt ... if your knee-jerk reaction was to cancel the whole order and stomp off and then complain .... my guess is that home renovation/makeover work "isn't for you".0 -

Disgraceful they sold items they had in stock to someone else.
Order from an other merchant and agree delivery date.
Also instruct them that if they have any items in stock or due in they have to keep them stored and not sell them to anyone else until after your items / order is delivered.
They have lost a sale they will be really upset about that. Not.
You have only lost a week or so in your work.
