  • upto 6 mths ago brittania were tame , but they have decided to have the last swan song before legalisation comes in

    they have done a deal with BW , to feighten all , most will simply pay up , and brittania and bw will be happy

    however I expect that the fee they are getting per case cannot account for lots of paperwork and challenges

    they may just fold if pressurized enough , if waitrose etc get on there case it could kill a golden goose

    keep on at landowner , get them to intervene , the thought of loosing contacts due to BW action may spur them

    totally agree but the RK is really frightened about having to go to court over this and they are hoping that it wont actually get to court if the BPA and or Waitrose do the right thing. They are panicking about this already so a lot of pressure will be put on Waitrose to do the best that can be done to get them to instruct BP to kill this dead.

    The first thing I said to the RK was to never take a phone call from BW nor under any circumstances phone them either.

    Absolutely pressure will be maintained with Waitrose as per my other reply and te landowner are the local council so a complaint can be sent to them as the RK needs to write to them asking about the planning permission aspect and what the time limits were the council allowed for.

    Also BP have refused to give any details of the contract between them and the landowner. So in order to obtain a copy of this would this need to be done under a freedom of information request as this is being seen as "business sensitive information"

    A FOI is to authorities such as councils

    Britannia/BWL have said they would show it in court. AGAIN, get this killed off by Waitrose

    Thanks very much Umkomaas - they did that in the email they sent through - and thank you or the link - very helpful - a reminder to BW about this will be included in the follow up email from the RK later today .

    I am waiting for Britannia Parking to respond to a SAR and I am also seeking debt advice. I therefore suggest that you delay any intended action.

    I would like to add that your client has failed to comply with the requirements of POFA 8 (4): As such, they cannot hold me, the keeper, liable for the actions of the driver.

    I'd be a bit careful about the bad publicity idea in this particular case (personally I am not sure how effective it is, anyway, but that's a different discussion)

    Worth remembering that we are talking about a repeat offender here - continuing after receiving tickets. And IIRC - I am not going to go back through this huge thread - there may be more tickets out there?

    People may be sympathetic to a one off story but if Waitrose responded in this example saying ''multiple offender - continued after receiving tickets - normally we are receptive to cancelling tickets but I am sure you will understand in this incident... etc etc" I can see any sympathy draining away.

    And, as discussed elsewhere, the GP are not up to speed on the intricacies of the laws surrounding parking. Indeed, I can see them thinking "good on you Waitrose" - it's hard enough parking anyway and it's made more difficult by people breaking the rules.
