    they can chase as long as they want , they can continue to write to you for the next 30 yrs

    HOWEVER , they can only start county court proceedings , 6 years in England and wales, 5 years in Scotland


    should they continue in letters after those dates THREATENING court action , then YOU can take action

    thank you beamer guy - I did have the 6 year figure in my head and so it would seem that the doctrine of laches may not apply as its only 2019 so they are well within the 6 years .

    Nobody said about chasing, that could go on forever.

    As you say, court proceedings are limited

    Thanks guys - so I think we wont complicate things with the Laches unless its deemed necessary.

    I would be very grateful if anyone can offer thoughts on my question in post 161 https://forums.moneysavingexpert.com/discussion/5985916/waitrose-bw-legal-britannia-parking-john-lewis-legal-team&page=9#161 above about whether or not we keep in the question in the SAR asking BP to give a list of all Parking Charge Notices BP consider are outstanding against them or not,

    RK not panicking as much today as last night but is very concerned about this .

    Laches is very applicable.


    The doctrine (one of the maxims of equity) runs alongside the stricter common law remedies, & is concerned more with fairness (ie, is it just, all things considered?)

    So the RK was extremely uncomfortable about leaving in the SAR the bit about asking BP for a list of any other PCN's they consider are a are outstanding against them so they sent it off without that question in there. the emails were also sent to Waitrose & cc'd to JL, BPA & BW Legal.

    Interesting automatic response and a prize will be awarded for anyone who can spot the appalling mistake in their grammar!!!!

    I am sure that everyone who has been here for a while is more than familiar with this response so i haven't copied all of it but its the first one i've ever seen and as such I am surprised that they state that picture packs and copies of the signage will be provided as evidence at court.

    Is there any response the RK can go back to BP with at this time to challenge them on this. for the signs its irrelevant anyway as the RK has all the pictures of the signs from 2016 and as they are now
