Debt Collection Notice but no initial Penalty Notice - Indigo and ZZPS

    How about I send the following to Indigo/Saba (looks like Saba bought them out):

    To whom it may concern,

    In reference to Penalty Notice Number XXXX, I did not receive an initial penalty notice, but instead a Debt Collection Notice from ZZPS. I was therefore unable to appropriately enter into the appeal process within the 28 days stated. I wish to appeal this notice, and request a parking code to appeal.

  • and send them a SAR which should in theory show the NTK sent out within 14 days

    send a email to BPA and ask for advice , no NTK recieved , threats from ZZPS

    Thanks @twhitehousecat - I have just emailed BPA for advice and have drafted up a letter to post to Indigo/Saba asking for parking code and SAR.

    Be careful what you say in letters/e-mails to parking companies. If you are contemplating sending that script above, I would caution you to change it to make sure that they know you are writing as KEEPER not DRIVER.

    Re. Penalty Notice Number XXXX

    To whom it may concern,

    In reference to Penalty Notice Number XXXX, as the registered keeper of the vehicle (Registration Number: XXXX), I did not receive an initial Notice to Keeper, but instead a Debt Collection Notice from ZZPS Limited (dated 25th March 2019), regarding a supposed offence on 10th February 2019. I was therefore unable to appropriately enter into the appeal process with Indigo Park Solution UK Limited / Saba Park Solutions UK Limited within the necessary 28 days.

    I dispute your 'parking charge', as the keeper of the vehicle, and deny any liability or contractual agreement. I wish to formally appeal this notice, and request a parking code in order to appeal.

    I would also like to request a full Subject Access Request, under the General Data Protection Regulation (GDPR) (Data Protection Act, 2018), and request all data held on myself under Article 15 of the Act.

    This is why I favour ignoring it. Engaging with them gives an opportunity to drop yourself in it. The capacity for those unfamiliar with the ways of private parking companies to mess things up seems infinite.

    Thanks @waamo - is there any risk associated with just ignoring it? I assume ZZPS will continue to hound me with debt collection notices and eventually threaten further legal and court action? I would rather try and sort it out at source, but if you think this is a bad move I'll leave it. My aim really was to try and get a verification number so I can appeal with POPLA (or is this the same as my penalty notice number?)

    There is no POPLA appeal for penalty tickets so an attempt to get one is futile.

    The only risk to ignoring it is one of paper cuts from the mountain of letters they send.

    After 6 months from the date of the offence you can demand they delete all your details. So far they have complied when posters have done this.
  • they can threaten al they want , but they CANNOT start court action , get a dialogue going with BPA , get that SAR into indigo , you want PROOF that a NTK was sent , because they never sent one and are taking the pith out of the BPA

    the more complaints the BPA get , the more chance they will sanction them

    Letter doesn't drop you in it but, as separately advised, might be an idea to wait it out.
