You said to come back to you if needed and I would appreciate more advice. Since I last wrote here I have had two letters demanding payment which I acknowledged receipt of but denied any liability.
I have now received a further letter increasing the demand to £140 and stating that they will instruct 3rd party collection agents .
They then state that following above they may then instruct their legal department to commence proceedings.
1. Should I acknowledge reciept of this letter and deny liability or ignore it?
2. Am I correct that they cannot instruct 3rd party UNTIL they have had a court judgement in their favour?
3. What do we do if they do arrive at the door?
I am quite prepared to go to court over this matter as I do not believe they have grounds to make this charge.
Thonk you for your help

Hi, have a look at my 'Port of Wells' thread. Mines been going on for almost a year and got up to £182 and threat of court action. I have today received a letter from CE confirming the notice has been cancelled.
Main points were:
They can't pursue the registered keeper on this land.
The signage is inadequate for the changes to parking rules that have been made.
Norman Lamb MP has written to Wells Harbour Master expressing concerns about the signage as he has had so many people contact him.
Don't give up!0 -
I'm in exactly the same situation. civil enforcement & popla appeals exhausted, harbourmaster not interested. We bought a ticket 16mins after arriving. The car park was very busy and we waited for a space unknowingly on a timer.
Did you write to MP Norman Lamb? What did you say?
I unfortunately admitted I was driving but I had nothing to hide.
We still have the all day ticket which shows the time and our reg number.
My wife wants to pay for it to go away but I'm not giving up without a fight.0 -
HI
I have just received "letter before action - claim for debt"
The debt outstanding is listed as £182.
Is this another letter for me to ignore or do I respond that I have no liability?
If they wish to proceed to court I am quite prepared to attend. If they drop out at the last minute and I have occurred costs as a result how do I claim for those?

It gives 30 days to reply with completed claim form.
It does not contain any financial forms but gives link for information sheet, reply form and financial statement.
It has NO particulars of claim (other than date etc and breach of t+c) and NO proof of what they are going to rely on.

Then it's a LBC so follow what the NEWBIES thread tells you to do at this stage and by all means reply and ask for disclosure of the evidence they intend to rely on, and whether they are relying upon the POFA, etc., and whatever else you are wondering about.
They have to enter into comms with you at this stage so ask for what you want to know, so that it will be easier to defend when the claim arrives.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
