In accident and not at fault but problem with my insurance

    As stated above, it nearly always asks on the quote or schedule do you have use of another vehicle.

    The answer to that gives a bit of an insight to your driving history and experience but has no bearing whatsoever on the driving other cars permission on your policy.

    Indeed - the insurance certificate wouldn't have anything to say on the matter of if you have access to another vehicle. That info is only important to the insurer, as a factor towards how much they charge you.
    It isn't one of the criteria that validates or invalidates your insurance cover.



    For instance, I'm a named driver on my mrs' insurance policy.
    But that bit of information does *not* appear on my own insurance certificate, as it is not relevant to that document - it isn't relevant to whether my own insurance policy is in order.
    The insurance cert is the proof that my own insurance policy is in order, it doesn't say anything about any other insurance policies I may or may not be covered on.


    So in the same way, your statement to your insurer (proposal) that you have access to another vehicle, is neither here nor there when it comes to your own insurance cert.

    Just to be clear, I'm much more inclined to the "take responsibility for reading your documents" camp, however this is a forum where people come to ask for practical advice, and in this instance I think it's worth making a complaint to the FOS on the basis that the Proposal wasn't clear as to the meaning of the question and answer regarding other cars. Let's put it this way, if the FOS can rule that a policyholder's signed statement on a claim form is effectively worthless in demonstrating bad faith (which they have), then they could pretty much rule anything.

    I'm afraid you're in bother then. As others have said, get your friend to recover their vehicle costs from the third party. You'll just have to deal with whatever penalty comes your way for not being insured.

    Along the lines of jimbo, post #24 - it looks like OP has a Certificate of Insurance that doesn't mentioned being insured on other cars, third party, with that person's permission, but it does mention this in the proposal? If that's true, the insurance company is being misleading.
    If it's just the answer to 'do you drive other cars? Yes' then there's been some confusion about what that means.

    Your proposal saying Have use of another car does not mean you are covered to drive other vehicles on that policy it just means you’ve answered a question asking if you have use of other vehicles ie company cars/vans, for example I am a named driver on our company policy so answer yes to have use of other car.

    Suggest you phone up your insurer.
    They would have denied your claim either way because cover for driving other people's vehicles only covers third party damage, it doesn't cover the car you are driving.
    So phone up and check if you have third party insurance for driving other people's cars


    But really it should say on your insurance certificate.

    I don't know why people keep stating this as fact. My insurance gives me comprehensive cover on any non hire car that I drive with the owner/keeper's consent. Yes this is not typical, but it is still possible.

    Not sure if this has been covered (started to read replies but need to go out in a minute so had to stop reading) but the above means you have said that you do have use of other vehicles - not that you are covered for use of other vehicles.

    Even if you were covered, its usually only third party cover. My own policy is fully comp and it does specifically state I am covered for driving other vehicles but there are conditions attached. Those conditions are its third party, I must have the owners consent, the car needs to be insured and the owner cannot be my partner/spouse.
