    Giving it to charity or selling it would be the same under the theft act.

    I'm not sure of the point you were trying to make then. Once the pcso told him to dispose of it the method isn't relevant.

    The point I was making was that the PCSO said dispose or give it to charity. Selling it was never mentioned.
    The OP's complaint is that his CEX account is now blocked due to trying to sell it and is blaming the police. However the police never mentioned selling it, so he has no complaint against them.

    As I've already mentioned (and shown diction definitions of this), the disposal of goods can include the selling of them..

    Even the police in the UK accept this as a valid definition as it's the very same wording that they use when they auction (sell) off unclaimed lost & found goods and stolen/recovered goods.

  • One further question powerful_Rogue, if disposing of something does not include selling it, why then did you state otherwise in a post a couple of years ago?
    In that post you clearly told someone that they could dispose of a phone by selling it!
