    Trying to copy and paste huge chunks of text from Word into the forum will do it. Better to use Wordpad.

    You may get a DQ from Gladstones in the meantime: remember to ignore it and only use the one sent by the court (or get one from the courts website), as KeithP will have mentioned when he confirmed the deadline dates for your AOS and Defence for you.

    hi, I'm back. so we got DQ from both Gladstones and CC. we ignored the first one and now have to fill in the other one, any help much appreciated.

    I'm assuming I don't want to enter into mediation and tick NO?
    next question ask me if I think the case is appropriate for small claims? do I tick yes?
    hearing venue, I'm going to appoint a court nearest to my house, it's about 2,5hours drive from the golf course so hoping gladstones won't turn up.

    Now, for the expert evidence, what do I put there?
    d2 "are you asking for the court's permission to use the written evidence of an expert?" yes or no?

    d3 how many witness apart from yourself will give evidence on your behalf? is it worth trying to find someone, not sure who that would be?

    that's it for the questions.

    Any help greatly appreciated

    Once complete, send it in the same manner and to the same email address that you sent your Defence. Refresh your memory by re-reading post #2 above.

    Send a copy to the Claimant - address on your Claim Form.

    Got a letter from the court the case was assigned to saying the district judge has considered statements and allocated the counterclaim to the small claims track. it also states that having considered the paper in the case the court believes the case is suitable for mediation and encourages to arrange appointment. Tells me how to accept the offer but doesn't say what to do if i don't want to do it. I am assuming i should ignore t and wait for further correspondence?

    also, it says "you must comply with the terms imposed upon you by this order: otherwise your case is liable to be struck out or some other sanction imposed. if you cannot comply you are expected to make frmal application to the. court before any deadline imposed upon you expires

    it tells us the hearing of the counterclaim is goig to take place end of august, i assume this is the court date and i should start prepping for it if not accepting mediation?
