    You need to read the NEWBIES thread post #2 and you will get a LBC then a claim, and can defend it. That sticky thread tells you exactly how and what the procedure is, and that there is NO RISK. No CCJ, no huge costs, always worth beating a scam.

    We've just received a "Final Demand, prior to commencement of court action. Do not ignore this letter.
    Unless payment received by 23rd May, proceedings will be commenced before the Civil Courts for recovery of monies owed together with allowable legal costs, without further reference to yourself.


    Can we presume this is the final letter before court action or another one of their pay up or else we'll send you another letter to pay up again?

    If it was a real LBC it has to give 30 days and 'PAP 2017' reply forms.

    Thanks Coupon-mad, it didn't have any reply forms with it.
    This letter is giving till the 23rd May to pay, previous letter gave to the 8th May to pay. This new letter was dated 9th May, nothing written about 30 days.

    Not a Letter of Claim then.

    A debt collectors letter - ignore it.

    Update.....
    They are still trying....
    We had a letter off PremierPark dated 9th July 2019, stating as you have failed to pay so this has now been sent to our legal team bwlegal.
    Same dated letter off bwlegal, pay up within 14 days or we will start legal proceedings.
    Letter dated 25th July 2019 from bwlegal saying we have been instructed to commence legal action against you.
    enclosed are information sheet about avoiding court action a reply form and an income and expenditure form.
    Additionally the debt of £160 if not payed would increase to....


    Debt + initial legal costs.. £160
    Estimated interest.............£11.77
    Estimated court fees.........£25
    Estimated solicitors costs..£50

    Estimated total.............. £246.77


    So up to now we started with PremierPark, they moved us on to their legal team PPLegal, then back to PremierPark then onto their (other) legal approved team bwlegal.... Wow

    Post#2 there covers Court claims right through from the LBC you have received to the hearing

    Keep that post as your Bible till this reaches its conclusion

    This was just an update in case anyone else has the same problems and what they can expect.

    Typical BWLegal ABUSE OF PROCESS claim.

    So this is a Letter before claim and should give you 30 days to respond and rebut.
    Did they provide proof of their claim, pictures etc etc.

    As the amount of £160 is fake and the debt is £100, you need to ask BWL how they account for the add-on £60

    The interest charge should be dismissed by the court on the basis of why did they take so long to issue a claim.

    They are misleading you regarding "estimated" the court fee of £25 and legal costs of £50 are set amounts, not estimated.
    A judge may care to ask BWLegal what they mean by estimated

    The £60 add-on has been deemed as Abuse of process as you can read here

    Thanks for reply beamerguy.
    They class it as a "Letter of claim" and give 30 days to fill in and return the forms.
    Premierpark initially sent proof of claim and pics of car leaving car park, then I asked for SAR and got full pics and times/dates etc.


    I thought it was best not to respond at this stage?
