CCJ email

Hello,
I have had an ongoing case for almost a year now with Britannia.
Ive got to the stage where I received 2 letter before claim forms from BW in Feb and now a 3rd.
I issued a subject access request for the first two and advised them that claims must be for “all PCNs they consider outstanding” and not in seperate claims, I received the SAR from them, but now have two emails stating A COUNTY COURT JUDGMENT HAS BEEN ENTERED AGAINST YOU.
Are they able to enter multiple CCJ’s even though they all relate to the same car park and same 2 week period?
Thanks for any help.

Did you receive a claim form from the county Court that you didn't do AOS or defend? that would be the only way a CCJ could be entered against you.0

Two letters before claim in feb, assume you mean last month.
Each LBC gives you 30 days to respond .... what did you do. Did you think a SAR was a response ?
Even if you ignored them, you would have received court papers and even then it will take a couple of months before court.
It's only a court that can issue a CCJ ???0 -
The claim forms I have are from a BW legal representative and contain the address of County Court Business Centre at the top.
When I sent the SAR last month, as I was under the impression they couldn’t make several seperate claims, I thought they would have to group these 3 claims (for all the PCN’s) together as one and send a claim form covering all of the outstanding PCN’s.0 -
So have you received a genuine CCCF from Northampton with a username and password to log onto MCOL or is it just empty threats from BW Lying legal.0

This is the second part of the email.
IF YOU PAY IN FULL BY XXX 2019
You can ask the court to cancel the entry on the register. You will need to give the court proof of payment which we can provide to you.
If you also want a Certificate of Cancellation from the court, there is a fee for this.
IF YOU PAY IN FULL AFTER XXX 2019
You can ask the court to mark the Judgment entry on the register as "satisfied", and (for a fee) for a Certificate of Satisfaction to prove that the debt has been paid.0 -
I can see the MCOL that I can respond to online.
So must be not just BW0 -
Ok, so did you receive a genuine County Court claim form at any time within the last year you have been dealing with brittania scumbags and if so did you ignore it or acknowledge/defend it.
I'm not one of the experts on here but I'm struggling to see how you can have a 'Default CCJ' and know nothing about it.
If you have got a default CCJ and you have got the chance to pay BEFORE the 30 day deadline expires so the CCJ is not rubber stamped, you would be better off paying it without delay otherwise its on your credit file for 6 years!!0 -
Well these 3 claim forms I have are now clearly what you are describing. So the first 2 claim forms I have are now past the deadline. I have a 3rd which I will now respond to.
I’ve just received today’s post while writing this and have 2 letters from Courts Re the default judgements being issued and that I owe the money. It’s well over £1000 at this point.
The whole process has been so convoluted and I have this 3rd claim form now which I still have until 24th March to respond to.0 -
What have you received through the post via Royal Mail?0

So you need some expert help from the regulars, good news is you will get some. As I said I'm not one of the experts here but I've read a LOT!!
You need to post IN DETAIL (preferably in date order) ALL the Court claims you have received and see what help the regulars can offer, they will need name of claimant, date/s of issue, particulars of claim and what you have/haven't responded with. You may still be able to salvage some of this mess BUT information you post will be key.
The main issue the way I see it is the 'pay by xxxx date' to AVOID CCJ, this is well worth doing to avoid a 6 year credit file trashing, I am not saying £1000 is nothing but in the grand scheme it is compared to trashing your credit file.
The 3rd claim IS defendable if your correct with your dates, wait to see what the regulars advise but do go to the NEWBIES section and read all about Court proceedings.0
