UKCPM Ltd/ Gladstone’s county court claim form

I’ve received a claim form from UKCPM LTD & Gladstone’s.

I parked in a poorly marked disabled bay (small worn white disabled sign on the ground) which was wet in a poorly lit underground car park in March 2018.

I received a pcn on my windscreen so took photos and sent them off as defense of the claim. I heard nothing back so presumed it had been cancelled.

I have now received a county court claim form, dated 25/2/19, which I have acknowledged and want to defend.

However I’m now stuck. I’ve read lots of other threads but am struggling to find a template to use for my defense.
I haven’t been back to the car park and can no longer find the pictures.
Do I just pay them or do I still have a case?
I would’ve just paid the original fine if I knew I’d not been successful, but it’s now £246.48 and I can’t afford that as a single mum of twins.

Any help would be greatly appreciated. I’ve tried looking through the newbie threads (as directed by lots of people) but am completely confused with the amount of information.

Thank you for your time.

With a Claim Issue Date of 25th February, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 1st April 2019 to file your Defence.

That's nearly three weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.

When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Post #2 of the NEWBIES thread (link above) has several examples of Defences that you may choose to base your Defence upon.

Take particular notice of those concise Defences by Bargepole.

I note in your opening post that you have revealed the identity of the driver. That's fine if you intend to defend as the driver, and in some cases it may be easier, but to give yourself more options I would suggest you edit your post.
Only refer to what the driver did, and what the keeper did.
It was the driver that parked the car and it was the keeper that received all the correspondence later.

No, that was not a 'defence to a claim', it was a pointless appeal where you could never have won. The entire industry peddles a scam.

Luckily, at court stage (if you settle down and just read the NEWBIES thread and stick around for advice at each stage - after consulting the NEWBIES thread each time, please) you have a 99% chance of success, going by our stats.

It really is not difficult to read, copy & adapt bargepole's example defences.

  • I feel really stupid as I’m reading the newbies thread and am so overwhelmed by the information. Maybe reading it on a phone isn’t ideal. I’ll try have a read through it at the library on a computer as it’s jist a lot to process.
    Thanks

There's your problem! NEVER NEVER NEVER READ THIS FORUM ON A PHONE.

    :)

You have absolutely no chance of reading the info you need, on a tiny screen where half the links & extras like signatures don't appear in the normal place.

You do know there are lots of stages and you must view the forum properly, every week or more? There is no quick fix, you can't read what you need to, on a phone, at all.
