That may be so , however i was still paying PPI after 2005 for a further 2 years on the policy surely that has some bearing

A missale complaint as about the sale.
Whst i am worried about is they decline my complaint on the base it was through a third party , ie the car dealership. Having gone past the deadline do i have any chance in making a complaint , and given B H has delayed my claim so long and as a result of their actions made me miss the deadline to complain against the dealership surely they have some responsibility, any one any ideas thanks ,,

Car dealers were not regulated until Jan 2005. So, if your Black Horse case is one where the dealer has liability as it wasnt a Black Horse staff member or agent that sold it to you then they would never have considered the complaint before the deadline. Let alone after it.
  • I also have a ppi claim against blackhorse. They have been looking into it for over 6 months now. I had an 8k car loan with them back in 2001. What are my chances?? Any help would be appreciated. Tia.

1 - you have not given your complaint reasons (so without knowing what you are complaining about, we cant say)
2 - Most BH finance linked to cars was not sold by a BH agent/employee but by the car dealer.   BH have no liability for sales made by car dealers unless the dealer was an agent/employee of BH.     Although they do take on the plevin liability

  • So moving on from my statement earlier , i have received a letter from B H v  up holding my claim , however they have only offered £285.00 on a £5000 loan  from 2002/2003   surely this cant be right   ,  whats my next steps  ?
  • Also i have looked into their response   they  are saying i made only 3 out of the 84 payments stipulated this is impossible otherwise i would have been reported , however i have no documents or anything else to say otherwise , hence the low repayment, it is likely i did a re mortgage at  that time and paid the whole loan off but im sure that was not the case and i made all the repayments

Why is it surely not right?

What is the breakdown of the redress? What did you calculate it to be?
  • Firstly my PPi was £562.  according to them added on to the loan , and looking at all PPi calculations it should be around £2200, my issue is also they have said i only made 3 payments off an 84 payment plan , this is immpossible as it was for a car and i had the vehicle for 5 years so there would have been recriminations on me not paying , but its that far back i have no way of proving anything, but there is no way i made only 3 payments..
  • Also they have calculated re payment is £137,00  with  £4.60 interest , totalling £142.00  redress ,  the £175.00 gross interest  then less tax giving a payment of £285     seems a fob off for a £5k loan with PPi ,

If you have no proof and they have no records, you have nothing to complain about. You can escalate your compaint ot the FOS if you want to, who may instruct them to pay as if you did pay all installements, but if they do have records and they are right, your are not entitled to any more redess that you paid plus associated interest and 8% simple.
