Dear landlord,
I am disappointed with your response and having sort legal advice it has come to our attention you have failed to adequately protect our deposit, this entitles us to sue you for its return and to claim compensation of upto 3x the amount.
Due to the lack of deposit protection we are now unable to use the arbitration the deposit schemes offer to settle the dispute over damages. I would also note that you have not supplied us with an inventory and the repairs and decoration you claim are required seem to be betterment.
I request you return our entire deposit in full within 14 days or we will have no choice but to sue you for its return.

I will of course update all on what happens. Will write the letter today using tom9980 draft as a template. I will include the date she had to put the deposit into a scheam which was in may 2012 just so she can look it up.
Part of me feels awful going for more than the 500 that we paid , that is really all i want back, had she originally said upto 200 off i'd have taken it and not bothered going further but its the way they have gone about it that gets me. We offered to put it back they said dont bother and we had both our houses due to early compleation for 5 weeks and i was off work for 2 decorating the new house so i could have sorted it out . As it happens i go away friday with work for 10 days . Upon my return i should no more but i will be kept updated . I just hope that we dont open a can of worms and end up getting sued for not putting it back. Thanks for everyones comments i never expected to get such help to be honest . A great forum0 -

What's to be gained by not telling them the OP has knowledge of the 3x deposit option?
It's all to easy to say I'll sue you in court, it's much more effective to say I'll sue you in court for XX reasons. If all the OP wants is their £500, this gives them more of a punch to get that back quickly.Make £2026 in 2026

Letter before action: Failure to return my deposit for
I am the former tenant of the above address, which you let to me on an assured short hold tenancy starting on 1st July 2009. My tenancy ended on 28th Feb 2019 after sufficient and agreed notice.
The property has been left in good order and the rent was fully paid to the end of my tenancy.
I am writing concerning the deposit I paid to you as a security against my obligations under the terms of my tenancy agreement.
I am concerned that none of my deposit has been returned to me and you have informed me that none will be

I understand that my deposit was not placed in an insured deposit scheme confirmed on the phone by yourselves 11.03.2019 after seeking legal advice on this all deposits paid to Landlords since 6th April 2007 had to be transferred into an insured scheme buy 6th May 2012 under sections 213 & 214 of the housing act 2004. As this is not the case and we have not been able to agree over the phone the return of the deposit failure to return the deposit will result in further action which could result in 1 – 3 times the original deposit being awarded.
I look forward to your reply within 7 days of receipt of this letter.
