nope, any evidence is in their evidence pack (you havent told us yet if you have been notified of this event, which is prior to any popla decision) - at this point you get 7 days to rebut it

post #16 overleaf on page one also told you to wait for the evidence pack and then comment on it in your popla rebuttal chance, so you can address this landowner issue in your rebuttal
this comes BEFORE any decision by a POPLA assessor, and clearly hasnt happened yet (so you are putting the cart before the horse)0 -

I have today received Britannia parking evidence to support their case against my Popla appeal.
Regarding the issue of landowner authority they have enclosed a copy of their contract.
It is dated the 5th October 2016 and is signed by .........

Surely I have them don't I.
I have an e mail from CBRE stating that they had no contract with Britannia from Dec 14th. The incident took place on the 20th January.
Am I right in assuming that if I attach the e mails from CBRE and KMP both stating no involvement with Brittania then I should win.
I have 7 days to draft and send my rebuttal.
Any advice would be appreciated.0 -
I do not believe that you can attach evidence to your rebuttal
and your rebuttal is limited to 2000 characters
you can state that they do not have a valid contract because you have the evidence
I suppose you could email or phone popla and ask if you can email your rebuttal and attach your evidence (but any evidence should have been attached when the popla appeal was previously uploaded)
take apart their evidence and look for issues with signage , POFA and anything else relevant to your case, dont get tunnel vision about the contract at the expense of everything else0 -

If you're careful I would imagine you can state the facts that are now in your possession succinctly. Give date CBRE signed contract, quote from CBRE's email re. date contract ended, state that KMP have told you they do not & have never had a contract with Britannia, conclude that contract was not valid on the date of parking.0 -
So just to confirm I can't attach the e mail evidence I have now.
That's a blow because it's concrete proof that im sure would get this PCN cancelled.
Without proof it's just my word against theirs.0 -

Yes, reply to POPLA by email, heading it up:
'FTAO the Assessor - comments on the evidence - POPLA code xxxxxxxxxx'
Ask that your email is taken as your comments, and that the only reason for showing the landowner email is to disprove the operator's evidence, in support of your appeal. This is not introducing anything new, you are astonished that the operator is prepared to mislead POPLA and felt you must comment to show POPLA that the contract is expired/old and the parking firm is being disingenuous.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
