His most recent thing he has done is tried to scam PayPal, ...So he pretended to sel a laptop on gum tree and someone sent him the money ... and he managed to get £300 out of his PayPal account and spent it ... anyway that payment got reversed thankfully and he was -£300 PayPal.

Fast forward and he did it again to someone ...

...my husband has already spent another £300 ... So we have £300 of the £900 money left he sent.

What we have done is submitted the same amount £900 from his account to the one who sent it in the first place in hope that we will be in minus with PayPal and can just repay it bit by bit. ... Apparently he wanted to scam PayPal and not the inidividual himself ..

    ....

There is no need to make assumptions - you have told us yourself that your husband is a scammer and that he intended to scam.

OP I feel very sorry for you and your situation but you are enabling your husband.

It makes no difference if he intended to scam Paypal or an individual, both are as bad as each other.

    He needs serious help.

Jesus Christ I know I said that he tried to scam PayPal not the actual person himself is what I meant. It is all bad I know, I am a very honest person myself but trying to get money out of a very successful million pound company versus an average joe is different in my eyes. That was the only two times in his life he has ever done anything like this and the last as he has no PayPal account anymore and seems like the new meds have kicked in better than the last set he was on. I will get admin to delete this post I put it in this group as I thought I would get gold advice from the people who usually go on this board, which I have, not you new people who I haven’t seen write on here come in with your moral high ground I said don’t make assumptions as ive stated before he didn’t ask for friends and family payment t least read the thread then comment. I’m done here.

If admin wish to close the thread, so be it.

It may be better to move it to another board which is more appropriate, as it is not about bankruptcy it is about fraud.

Soolin's expertise on the way that Paypal works may point to the thread going to that board or similar.

Wherever it ends up, I hope that it doesn't continue with the judging and blaming of the victim of the scam. That's what crossed the line for me.

On further thought I have decided to refer this thread to the forum team for review. Whilst this particular forum is non judgemental I don't think that fraud and scamming should be something supported on MSE. I was prepared to try and explain the situation from the point of view of the poor victim who has been defrauded without making accusations , but I think trying to blame the victim or suggest that scamming a large company is perfectly Ok as they can afford it goes a bit beyond normal behaviour.

OP I am sorry if you feel you haven't been supported but I agree with some of the other posts that enabling or excusing this fraud will help neither you nor your husband. For your own health and well being I think you seriously need to think how you can go forward in this situation and I do wish you well.

Soolin we both want to repay the money and will do so, we have the court forms from him that’s claiming the Money back plus £60 fee that he’s had to pay to do it this way. We tried to send the payment back family and friends but because we didn’t have enough in his account because the money from this guy was gambled by my husband and the rest cleared his arrears from PayPal.

I am not sure how he got our address to send the court papers to but it’s fine because I wanted a secure way to pay without him trying g to do a charge back and recover the fees twice . I wondered as obviously it’s my husbands debt and he hasn’t got a job or any income if he could pay Like £50-60 back. Do the court pay him Initially and then he pays the money back to the court in instalments? Not sure how it works?

On a positive note though he’s on new meds and has started to improve and he’s suggested applying for a new job so we might be able to clear it quicker in a few months if this follows through.

    Hi,

I disagree with the opinion above, having just read your thread from the start.

I’m sorry for the mess you find yourself in, as regards the court process, it will go something along these lines, if he admits the debt, the court papers will ask for his income/expenditure, he should fill them in and put what he can afford to pay monthly, and remember, it must be affordable.

Once returned, judgement will be made in the clients favour, you will then be informed in writing, and be told when to start making payments, your OH pays the client at the agreed monthly amount, all the court does is make the judgement, he is responsible for the payments, not the court.

As long as payments are maintained, that will be the end of the matter, if they are not, the client could, at extra cost, engage bailiffs to come to your property either to obtain full payment, or remove goods, bailiffs cannot force entry to private property, so if that were to happen, under no circumstances allow them inside.

Keeping up with the CCJ payments will avoid further enforcement action.

Good luck with this, although your post is not technically about bankruptcy, I understand your reasoning in posting it here, I will close the thread now, and I hope you have got what you came for.
