Hi there,
I've received a Claim Form last week from UKCPM and have just acknowledged it.
The alleged offence occurred about a year ago and I have received multiple letters in several different guises which were all completely ignored and not appealed. I had not received a letter before claim prior to this.
The incident revolves around around a gym which has external privately owned parking which has a limit of two hours. On one of these days, this limit must have been transgressed. We were sent the fine via post with pictures for evidence addressed to my mother, the registered keeper of the car. Both my brother and I frequent this gym, and we do not know who was driving on that particular day
The sign can be seen up close.
I plan to revisit the site to post pictures of the overall layout of signs.
I obviously intend to fight this to the end. I do, however,have my final medical school exams running concurrently, so I will likely submit my defence a day or two before the deadline after my exams finish. In the mean time, I am reading through previous cases to get an idea in regards to what is needed for a defence.
I am lodging this post to get any further suggestions or address any questions up until the moment where I draft my defence.

Do you mean a claim form from Northampton CCBC? Did you do the AoS via MCOL?
Send an SAR to the PPC so that you receive all the data they hold on you, which should include the initial PCNs and letters they sent to you. If you are going to defend, you need to know what you are defending.0 -

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .You never know how far you can go until you go too far.0 -

I have done the AoS
That's over three weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
- Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

With a Claim Issue Date of 25th February, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 1st April 2019 to file your Defence.

33 days from the date of issue - there are 5 days added (to the standard 28 days) for service of the claim form from Northampton CCBC to you.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

On page 14 of that document it says:How long does the defendant have to respond to my claim?
The court will send out a claim pack to each defendant once the claim has been issued and allows 5 calendar days from the date of issue for the service of the claim. Therefore the 'date of service' is the 5th calendar day after issue. Please note, if you have served separate particulars of claim then this may affect the deemed date of service (as above).
The defendant has 14 calendar days from the 'date of service' to file a response. If the last day for filing the response falls on a day that the court is not open (i.e. a weekend or public holiday), the court will allow the next full working day for a response. The defendant can extend the time to respond to 28 calendar days by filing an acknowledgment of service (AOS).0
