Help needed to challenge Smart Parking Parking charge notice

Any advice on best way to challenge a parking charge notice from Smart Parking? GP ‘s car park, free car park,no time limit, validation machine to tap in vehicle registration. Disabled blue badge displayed correctly. Monitored by cameras entry and exit. Validation machine notorious for catching people out. Thought I had put all info in correctly, PCN doesn’t say anything on validation.Says either not paid for parking or overstayed in accordance with t’s and c’s pm signage. As it’s free and no time limit seems wrong. Photo they have sent of reg on entry is mine but on exit photo it is not as clear and appears to show a different letter a B instead of a D. Was there at request of Dr with elderly sick mother. Any draft letters advice gratefully received

  • You state it’s the GP’s car park.

    Surely you have complained to the practice manager - quickest way to get this cancelled.
  • It’s a health centre several gp practices - notices up in surgery and on website saying to effect can’t help beyond confirming appt genuine. All queries to go to Smart P Surgery Have given me a handwritten scrappy card with a smudged stamp of their practice name and address on it

    Perhaps you need to point out to them The NHS patient, visitor and staff car parking principles.

    Particularly this bit:
    Contracted-out car parking

    NHS organisations are responsible for the actions of private contractors who run car parks on their behalf.
    The rest is worth reading too.
  • Have had quick read Newbies thread thanks for pointing me to this but can’t find anything similar, free car park , no time limit , validation required, disabled patient in car with Blue badge.
    Understanding The legal stuff on the threads is going to be challenging . I have not got beyond the angry stage yet
  • Thanks yes had found that NHS parking guidance it says all the right things but will it have any sway in reality with SP or appeals body.I am trying to find out who manages the Health Centre - I think someone out of the building from nhs property services and will complain to them and Practice Manager ( despite notices in surgery)

    No, of course not.

    It is guidance from Government to NHS Service Providers.

    As you say, you should be chasing the Health Centre management, and if they still refuse to help, then upwards to the NHS Trust involved.

    Definitely complain to the GP, I got randomly stung at Sunderland Hospital last year whilst parked in a disabled bay, my grandmothers badge was on show and my car was already registered, I think it was parking eye that alleged I had been parked and not payed.

    Contacted the hospitals security department, explained the situation and they were able to cancel it over the phone.

  • Receptionist to building ,not surgery ,said she could e mail them ( although claimed it wasn’t part of her job) but said if there was a validation error ie I made a mistake or hadn’t completed the entry and it hadn’t registered then they would not withdraw £100 charge. She said lots of people brought in charge notifications to show her/complain.

    You need to go to the practice maneger and make an official complaint. The surgery should not be profiting from this, by the sounds of things it’s a good source of income for them.
