  • Ok. This is not necessarily a done deal (yet). What - exactly - did the sign (i.e. the contract) say.

    Granted I've had a bit of training, but I managed to convince a court that the signage couldn't apply. I'm not the only one - see, for instance, PACE v Lengyl.

    In some cases admitting being the driver is much easier, because you can then say "I" without worrying about constantly referring to "the driver"

    'All vehicles must park within a designated parking bay at all times.No parking on roadways/hatched areas or pedestrian walkways.By failing to comply with the above terms and conditions you agree to pay a parking charge notice.'

    I just noticed something - how can anyone pay a parking charge notice?I am guessing they have to word it that way because they are not actually empowered to issue fines?

    Surely it is impossible to pay a parking charge notice.One could pay a parking charge,but not a parking charge notice.

    I reckon send the template appeal to PCS, saying no previous appeal was made. They are in the BPA so you need a POPLA code.

    That was my initial plan,I thought it might be worth a go.The fact PCS asked whether an appeal had been made suggested they did not have the information to hand.I have zero experience with PPC's and wanted to see whether it was feasible.

    My concern being whether it might mess up the POPLA appeal,if the original appeal came to light having previously denied its existence.

    I appealed online to Parking Collection Services on 8th of March.The letter from them was sent on the 8th of February,so I figured it was within 28 days of their letter and thus within their 28 day timeframe.

    I got an email today saying that it was not within the timeframe,and my nephew received a debt collector's letter.

    I apologise if this is covered elsewhere,and I know I left it a bit late to appeal but I am ill with a chronic health condition that is makes difficult to concentrate on this kind of thing.Could someone advise me if we can still go to POPLA,or where to look for information that can help?

    You can only make an appeal to PoPLA if you have a PoPLA code from the scammers.
    If you have a code then use it.

    Debt collectors of course can be ignored.

    I don't have a POPLA code because they are saying we missed the deadline for their appeal.

    I read somewhere on the forum that it is still possible to get a code from them even if the appeal deadline has passed.Do you know the procedure for obtaining one in this situation?

    I have read that it is best to ignore the debt collectors.In this case it is Debt Recovery Plus,and I am reading about them here on the forum.
