Hi,
I have read through the newbies section and familiarised myself with the basics of the situation,and searched the forums but am in a quandary.
A family member has been issued a windscreen PCN by AM Parking Services Ltd,demanding £100.I offered to help,and started to research the forum,but he went ahead and made an appeal without my help,and unfortunately let it be known he was the driver.
This was last November.He appealed via email,received a response asking if it was an appeal or refusal to pay,to which he replied it was the former.He received no further correspondence from them.
Then,over three months after sending the appeal email,he received a NTK,this time asking for £120.The NTK was not sent within 56 days of the windscreen PCN.It was sent by Parking Collection Services,acting on behalf of AM Parking.
Now here is my question.I know that it is a big no-no to admit being the driver.On the online appeal form for Parking Collection Services is a box asking whether an appeal regarding this charge has already been made,and another box to give details.
I am unsure whether to say that no appeal has yet been made,in the hope that,as we are now dealing with a different company and received no correspondence indicating a rejection of the appeal from the PPC,they will somehow be unaware of the original appeal,and therefore not have any information regarding the identity of the driver.
In which case,I believe we would have a good case when it goes to POPLA,citing 'no keeper liability'.Added to this is no mention of the POFA 2012 on the back of the windscreen PCN.If this is deemed a good move,we will use a different email address than the one used for the original appeal.We will be taking a screenshot of the appeal page as well,as recommended.
Could anyone help me with this?

The NTK was not sent within 56 days of the windscreen PCN.It was sent by another company,acting on behalf of the PPC.
Which parking firm?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes,I had read as much,just not sure where to go from here,how to fill out the appeal form with regard to the original appeal,and what way to fight it.

Could anyone help me with where to go from here,seeing as 'no keeper liability' looks out of the question?
The driver in question parked in what has been referred to by the PPC as a 'turning area' of a residential car park.There are a few signs up that state that vehicles parked outside of bays or in areas marked with hatches on the tarmac will be ticketed.
The signs are legible and obvious to be honest,but the area the car was parked in has no hatch marks painted on the tarmac,and the bay areas have no paint markings either,but are marked out with lines of bricks set in the concrete parking area,so still fairly clearly marked out.
He only parked there(whilst visiting a friend),because the residents park there,his friend's father said it was ok to do so,and the general consensus amongst residents seems to be is that it is not a problem to park there.
I imagine stating others park there is not likely to win an appeal.But he is young and naive and thought the PPC might actually be reasonable!
So he has admitted parking there,which means there is no point asking if they have photographic evidence either,and arguing against them on the basis of lack of evidence if they cannot produce any.
Would the fact that AM Parking did not send the NTK,but Parking Collection Services did instead,be a procedural error on their part?Or the fact that they did not reply to the original appeal?And therefore give us something to go on with the POPLA appeal?0 -
zachiti, you are likely to get much more support if you actually made your post readable.
A wall of text with no paragraph breaks is very difficult to read.
