  • The sons window ticket was from a company LPS - he’s had an email confirming it’s been cancelled.


    I have had my defence confirmed as received by the CC IN EMAIL & also a letter dated 14th March from tribunal services saying they have 28 days to respond

    - I requested sar info on 2nd March by email.
    - As of today I have not seen or received anything - do they tend to send it out recorded delivery / signed ?

    - if I ever receive it what am I looking for with regards to the PCN timescale & also the NTK dates / timescales

    - I emailed my defence in 13th March - am I right on thinking they have 28 days to respond ?


    System shows the following :
    Claim History
    Your acknowledgment of service was submitted on 01/03/2019 at 20:14:28
    Your acknowledgment of service was received on 04/03/2019 at 01:06:28
    Your defence was received on 14/03/2019

    But in response history it is showing last document is the acknowledgement of service

    they had one month to respond to the SAR which you would have included in the SAR itself, so not due yet, dont be impatient, post #25 above answered the same query in your earlier post #23 , plus posts #21 and #22 AS WELL !

    POFA 2012 gives you timescales for keeper liability to be enforced , the NEWBIES thread does go into this with various advice , explanations and examples

    the MCOL website (plus posts by BARGEPOLE and LOC123 in the newbies thread) tell you deadlines and timescales etc

    Why are you even asking that question?

    On 19th March, in the post immediately preceding, you told us:
    I have had my defence confirmed as received by the CC IN EMAIL & also a letter dated 14th March from tribunal services saying they have 28 days to respond
  • I received the sar paperwork by recorded delivery on 29/3.

    The pcn was generated 13 days after the offence. - is this also the NTK as the only other things enclosed are letter from cel legal dept & ZZPS debt notice x 2.

    I have 2 letters from QDR & the CEL letter of intention of court action that were not included in their info.

    Do I send in the directions questionnaire (via paper or email) now or wait until I hear from the CCBC

    When complete, return the DQ to the CCBC in the same manner, and to the same email address that you used when filing your Defence.
    To refresh your memory, have another look at post #2 above.

    Do not forget to send a copy to the Claimant - address on your Claim Form.

    What date (exact) and day of the week is the PCN dated?

    And, does it have the paragraph 9(2)f wording from Schedule 4 of the POFA 2012 in the payment slip at the bottom, or not at all, or elsewhere (e.g. on the back?).

    The POFA is linked in the NEWBIES thred but easy to Google & read 9(2)f.

    The creditor does not know both the name of the driver and the current address for service of the driver. We therefore invite you to pay or appeal the unpaid parking charge: or if you were not the driver of the vechile, to notify us of the name of the driver and a current address for service for the driver and to pass the notice to the driver


    I have now emailed my Directions Questionnaire to the CCBC & also posted a copy to CE ltd with proof of postage

    The deemed date of receipt would be 28th June which is day 15 after the parking event; so one day too late for POFA.
