Thank you for your assistance CouponMad et al,. To submit the N244 would this need to be accompanied by a defence? Or would the only accompanying documents be those paragraphs that you have mentioned previously?
With the 14 days being from 18 Feb. Would I have to submit the N244 no later than tomorrow?
I know you make mention to sending a cheque of £100, however if I didn’t own a cheque book, could I pay the balance online?
Best regards0 -
Hi,
I'm in the same boat as all of you, PCN Feb 15th. Well not me, but I'm helping an elderly relative with theirs.
I had already been considering whether to reply that there was no jurisdiction, when I found this thread!
Can I be added to the whatsapp group?0 -
I just phoned the cc business centre who advised that i could still contest jurisdiction even after selecting "defend" on the AOS as long as it falls within the contest jurisdiction timelines (ie 14 days) On a side note he did say are you absolutely sure you know what you're doing and suggested i get legal advice as "we get 1000s of parking claims".
In answer to that, no I'm not sure and i change my mind every 5 minutes!0 -

yes "we get 1000s of parking claims". but how many from this location and in those circumstances ?0 -
Can a legal eagle please advise whether we ALL have to contest jurisdiction to benefit from it, or if one person does it and is successful, can we use that in our defence, even though we would be deemed to have accepted the court’s jurisdiction by not contesting ourselves?0

Personally I would all do it, and post your N244s to the CCBC in one envelope if you are all local. I would meet up and do this together, and put a covering letter signed by all of you, listing all the claim numbers and saying you all wish to contest jurisdiction.
I think it would have more clout arriving in one thick envelope wit all your £100 fees and forms, asking for a decision on these cases without a hearing and for the Claimant to be ordered to refund your fees.
If the CCBC said you can then (if you decide this is the way to go for you) why not all email a fresh AOS today/tomorrow, saying it supersedes you last one as in fact you intend to contest jurisdiction? And copy in BW Legal too.
But you don't have to all do it. Up to you. Those who don't, could cite a successful case to contest jurisdiction in your defences as a reason why there is no cause of action.
And no defence is needed. In fact, YOU MUST NOT DEFEND if contesting jurisdiction or you would be accepting the jurisdiction!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've just been on the phone to the CCBC. They told me to send in my acknowledgement of service to them saying that I want to contest jurisdiction as I have been waiting until last minute to decide what to do.
They said that I can change my mind as to whether I wanted to contest Jurisdiction up until the 20th of March once this is done. They said that the important thing was to get the extension of time and that before the 20th I could, contest jurisdiction, defend the claim, or pay the claim off.
Hope this is of help to someone.0 -
Great, so now you can all decide which way you all go, albeit if it were me, I would do this as belt & braces, as I said earlier:If the CCBC said you can then (if you decide this is the way to go for you) why not all email a fresh AOS today/tomorrow, saying it supersedes you last one as in fact you intend to contest jurisdiction? And copy in BW Legal too.
To be absolutely clear, if you contest jurisdiction you DO NOT defend, at all. You wait to see what the District Judge then orders.
Hence why I think it would be great if you are all Newcastle locals and can get together in the pub one night and then send your documents in one envelope to the CCBC, with a covering letter listing all the claim numbers en masse, but with individual N244s, Draft Orders (all the same, but with different Claim numbers/names at the top) £100 fees (or your code if you have done the help with fees application online), and with one copy of the byelaws to support all the N244s.
Get proof of posting that, in fact I'd send it Special Delivery next day signed for, addressed clearly to the CCBC and marked 'URGENT - RE SMALL CLAIMS'.
Then the person who sent it can email or whatsapp a pic to all the others, to show it's sent. Don't miss any out!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Make sure you do this online then its processed that day (the AOS) if received before 4.30 on a week day0 -
I would echo Coupon-Mads advice, however i would differ in that i would send each application separately, because it is not unknown for the court staff to miss stuff even its if obvious in a cover letter.
If you send it separately then there is a paper trial for each application filed and signed for delivery isnt exactly expensive
You need to get on with it though.0
