I wonder if a summary of all these cases, names, dates and outcomes is worth an interested party like BountyHunter, sending to one of the more amenable local Judges by name, asking if the Judge will consider an order using his own case management powers, debarring UKPPO from filing or continuing with any more Newcastle Airport claims, without the permission of the local Circuit Judge first, and only if they set out in what way any new cases differ from all those discontinued and beaten in court by consumers.

UKPPO could possibly be described as a vexatious litigant, given the fact they are not winning cases and should be stopped from harassing consumers with meritless claims.

  • Massive Thanks to the regulars on here - we wouldn’t have had half the successes if we hadn’t been given the nudge to work as a group.
Many many thanks to everyone here who showed me how to write my witness statement, with reference to the bylaws. Your support also gave me the confidence to stand up to these dodgy dealers.
Today I got a discontinuance letter, two weeks ahead of the court hearing.
But it doesn't end here - I want to do whatever I can to stop these bullies extracting money with menaces from innocent motorists.

Very well done to such a collective effort. It has to be applauded

Absolutely agree. Team group effort to stop a p1ss-taking predator in its tracks. These Canutes think they can bully anyone and everyone with their nasty threats and harassment in order to steal money to make them go away. They are not interested in the legal case they are trying to make, they are just using the courts to smash individuals into submission and to offer up their cash to get rid of the knife in their side.

Well done BountyHunter and Co. :T

This thread is unusual in that we never tell people to work as a group, but this one was different from the start, given the Airport Byelaws and the fact UKPPO chopped and changed on a whim between calling ther PCNs 'penalty' or 'parking' charge notice from year to year and couldn't decide if they were acting on byelaws or not.

It was important that all new people were given the right advice, including the tactic to contest jurisdiction as a possible way forward, hence the group thread as this is a rare set of circumstances that the 'usual advice' would not have worked for and might have caused losses if we'd missed the nuances & got newbies to bung in a generic defence.

It was lucky we knew old stuff like the Park & Fly contract and the fact the signs were utter pants (hidden at ankle level behind walkways and wire fences IIRC) and that the PCNs usually have the wrong timing on them that doesn't match the photo 'evidence' sneakily and secretly obtained by CCTV, which one would think is there for security, not UKPPO's profit.

I hope one of you (or maybe ALL of you together as a group letter?) can all sign something to politely but formally lobby a friendly local Judge to pass the case to a Circuit Judge to sanction UKPPO and prevent any future Newcastle Airport claims.

Attach a draft order saying what you want the Judge to say, and cross your fingers.

I think in this case the Judges might consider it if they had such a letter from the victims, drawing their attention to the pattern of losses and that the claims clearly have no merit, are wholly vexatious and an 'abuse of process' that must end.

Happy to do that if the group are will to share their full names and case numbers (most have already)

Is that pretty much the wording to use - or anything else to add?

Forgot to ask - this was was from a previous adjourned hearing - can the defendant claim costs for attending?

I believe they write to the judge and ask for a costs order to be issued , especially if a costs schedule was filed or if costs were deferred in the adjournment

I'd ask bargepole what he thinks, as to whether this is worth a try and how to word it.
