How have they requested it? Via the DQ? What did you put in your DQ? Can you imagine the mediation conversation? Claimant how much do you want? - ALL OF IT. Defendant how much do you want to pay - ZERO. End of mediation! Normally recommended to decline.

Yeah that's how I imagine it would go down too, or at the very best they'd offer me the amount I could have paid originally. I declined mediation in my DQ, they have said they want it in theirs.

I've just noticed the email says "The above parties have all filed a Directions Questionnaire (N180) and have all requested mediation.", which is untrue, I definitely declined it.

    I'll just ignore. Thanks.

What e-mail? If the PPC have sent this to you, then it is evidence of unreasonable behaviour. If the CCBC sent it then you need to contact them and get it straightened out.

The email was from scmreferrals (Small Claims Telephone Mediation Service). I have double checked my DQ and emailed them letting them know their error, will send a copy to CCBC too.

Good response. Never heard of Small Claims Telephone Mediation Service. What an unfortunate name to pick!

They should not even be involved, as you said no.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I suspect VCS accidentally and erroneously told them.

The full email address is scmreferrals@justice.gov.uk btw, so I assume it's some sort of clerical error rather than unreasonable behaviour by VCS.

I agree, that's a proper mediation service but you ticked 'no'.

    Hi guys,

I've received a date for my case (end of February) and also received a copy of VCS' witness statement. It's quite a substantial file.

I'm working on my witness statement at the moment. Is there anything to be gained from naming the driver at this stage? Would it add weight to the statement about needing to stop due to choking?

Any new case law I should be looking at? Or should I provide any of what's in VCS' statement?

    Hi Guys,

I sent my Witness Statement off by email Yesterday. Today I've had an email saying "Please note the Court is unable to print this E-mail as it is over 50 pages in total." which I am taking to assume either means it's been rejected entirely, or it won't be available in court on the day. Either outcome is bad I imagine.

I took the Newbies thread literally and amended the full judgement for 'PCM v Bull', 'Jopson v Homeguard', 'Ransomes v Anderson', 'ParkingEye v Beavis', The POFA, POPLA Annual Report, CPR, CMA, etc. at the end of my file as evidence and it came to a whopping 400+ pages by the end.

I now understand this must have been a mistake due to the 50-page limit. Is it necessary to include those files at all? I already have the relevant excerpts included in my statement.

Today is the very last day to submit it. So I'd appreciate a reply ASAP if you know the answer.

    Thanks
