Bw Legal ccj threat

Basically I am out of my depth with this...

I got told this was an invoice and not a fine and to ignore by friends from day one.

I have now got a letter from BW Legal, previously britannia from 22nd December 2016 for not displaying a pay and display ticket in a pub/hotel

At the time this pub was my local, I had no change, so the barmaid at the time said she would put my registration down on her computer as I was staying in the rooms above. She mustn't of done this.

Balance due is somehow £235.30

I have now got this letter saying

A County Court judgement may be entered against you
As you are aware, we represent Brittania. We have issued legal proceedings against you in the form of a County Court Claim. You have failed to respond with any proposals for payment or why the debt is disputed.

If you do not contact us or respond to the County Court Claim, we will enter a CCJ against you after the 10th of March.

If a CCJ is granted they may enforce The CCJ through warrant of control, attachment of hearing and order to attend court.

I have no idea what to do can someone please help. Do these have the power to take it to court and enforce it?

Thanks.

They are trying to scam you, even if they won a court claim, the cost to you would be unlikely to exceed £200. These down market solicitors know this, but, because they are solicitors, know that a lot of people will pay up. Imo, this is fraud, or, at the very least, improper conduct.

I urge you to report this grubby law firm to their regulatory body, the SRA.

    https://www.sra.org.uk/solicitors/handbook/code/content.page

as I am sure they do not condone this conduct. Also, get your MP on side.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .

Have you received a court claim via the Northampton CCBC? If so, what is the Date of Issue, shown on the r/h side of the claim?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Welcome to the wonderful world of BW Legal claims!

Have a read through the NEWBIES post (post 2) which talks you through the claim process.

It would also be worth sending Britannia a subject access request to their DPO by email today. They have 30 days to respond with all information they hold on you are a data subject. There is a SAR template link in the NEWBIES thread (Legal Beagles one).

Right so you acknowledge the claim that arrived under separate cover from the CCBC, and then you draft a defence like the HUNDREDS of other Britannia defence threads here.

Easy enough, you could almost copy one. And 99% of people here, win.

And they all learned what to do, by reading the NEWBIES thread post #2. The pictorial walk through acknowledging the claim form online using a Govt Gateway account, could not be easier, for starters.

If the pub will not help, write bad stuff on TripAdvisor, Facebook, twitter, etc., and do not forget to complain to your MP.

Will the idiot friends that told you to ignore it not pay it for you as they got you into this mess?
  • Coupon mad... I am awful with technology and don't understand much of that :/

Not sure what steps to take or what to do to find them...
  • The NEWBIES thread is on the main parking board - it's a sticky post, so usually one of the very top three posts (right under where you had to click "New Thread"). Click into that post (title: **NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!) and then scroll down to the second post of that thread. It's then the walk through of the claims process.

It's a long thread, so grab a cuppa, take a deep breath and read carefully.
