Flat buying - seller turning nasty

    I checked that point with my girlfriend, and she said that if the property isn't in the condition it was meant to be sold in they would be in breach of contract.
    correct, and fine if the vendor was moving within uk
    but moving abroad doubt youve got any sort of recourse if anything happens

    Another rule of thumb in property transactions is that furniture and other effects ( eg, lawnmowers stuff like that is sometimes included in the negotiation) is "the price is the market value of that item second hand"

    therefore for a second hand coffee table of the ikea variety, Id be looking at the vendor charging no more than a fiver for it,

    When I sold my flat my buyer asked if some furniture etc could be included.

    I did a Fridge freezer, washing machine & oven (cosat new 1k, still in warranty) a king size iron bed & mattress, bedside table, wardrobe for IIRC 350.

    I didnt even spend 2k on all this lot new.

    In my experience, the vendor being 'in breach of contract' is no real protection and isn't worth the paper it's written on. We had a garden shed specifically included on the contract for a previous house purchase. On completion day we found the vendors had taken it with them. :mad: They were in breach of contract but our solicitor advised us that it would cost us more to pursure this than the shed was worth! ... and our vendors were still in this country! If they've already jumped on a plane with your money you won't stand a snowball's chance in hell of getting your money back!

    As this woman has already lied to you and gone back on her word so many times already what makes you think you won't hand over your money for her inflated furniture and overpriced flat and when you get into the place find she's actually sold it to someone else already? :confused:

    The other thing which puzzles me is, if she is selling you all her furniture and going abroad, presumably it would be easy for her to stay with family/friends or in a hotel for a couple of nights prior to her flight.:confused::confused: I really smell a rat here! :eek: Therefore, I would say you want to stick to the original completion date too.

    Please, please don't give in to her. In your position (unless I absolutely adored the flat and was desparate to live there whatever the cost) I would tell her I didn't want any of her furniture (she may leave some of it anyway) and that you want the original completion date (and possibly price) or you are walking away.

    Personally, I have thought of something much better to do to her... it involves a coal fire, a set of pliers and a 50ml hypodermic filled with bleach.... but thats another story.

  • How long has it been since you viewed other properties? Why don't you and your girlfriend have a nice Saturday looking at other places? Maybe you'll fall in love with something better. At any rate, it could help you be in a better emotional state to know that you can always buy someplace else.

  • Sent a letter to agent accepting completion date, but reducing offer for furniture to £500 or dropping sale of furniture altogether. Also outlined several aspects of the whole procedure I've been unhappy with.

    I know many of you (I'm talking to you jonewer!) may feel this is leniant but my girlfriend felt going back to the originally offered price for the flat itself at this stage would cause more trouble than it was worth, and require new mortgage offer and other paperwork. I suspect she just didn't want to have to draft new papers!

    Will wait and see...

    Yeah I've been looking at other flats on the internet, and have also told the agent that if this doesn't work out we've been more than happen dealing with them so will be open to the other flats. Actually for all I've ever said in anger about estate agents, the woman I've been dealing with has been a real mensch.
