The victim of a DPA/GDPR breach can sue for damages ... in the UK. But this is an aside ... the OP didn't receive the letter, the driver in the USA did (and shared the info with the OP). Therefore no obvious DPA breach as yet.

Of course they can, if they want all the problems that go with it

What problems? Other than the effort to raise a MCOL claim and sort evidence etc. (which any claimant would consider prior to starting the process anyway) what other problems exist in raising a DPA damages claim?

The precise problem, you might do that but most don't want to go to court and it does not follow the OP would win seeing the way some of the judges behave.

But, it's up to the OP as the system is open to eveyone

Are you an American ???? I ask because your answer seems to be to sue anyone. If a Data breach is proven, let the ICO take it on

    No I'm not American.

My answer is to sue anyone that is so stupid as not listen to my warning and continues a course of action that leads to an actionable cause and that annoys me enough to go to MCOL.

I don't need any money from them, it's just nice to put one over the scumcos and inept firms with no customer service/intelligence.

The ICO is useless....no it's worse than useless....because it actually spins it that they do so much when in reality they are hopeless. For example they claim 'big fines for robo-callers'...the reality is that the fines are never paid/enforced. The scumcos simply phoenix.

The money is on the OP not suing ever [even in their entire lifetime] ....99.9% of people who could, don't.

Fear, inertia, complacency, being rich, being poor, not knowing how....all of these are reasons why people don't...which is a shame.

Of course another reason might be that they have no cause of action.

After all, the OP has already told us:

Since I got the parking charge in November and told them who the driver was I haven't heard anything it was the driver who received a letter today.
Why on earth would the OP be suing anyone?
