    Going to make myself and "aide memoire" for the court. List of key points and important things I need say and do.

    Any advice please, its my very first time in Court.

    That would be your 'Skeleton Argument' (SA), which you should copy to the Judge (so he/she is aware of the points you would like to cover), and to the Claimant (so they know what they might have to deal with - no 'ambushes' are allowed).

    The SA should be submitted a few days prior to the hearing, and you should take the opportunity to submit your costs schedule at the same time.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Thanks Umkomaas, I did my skeleton with my witness and added to the bundle.

    I'm just wondering about costs, since I had my Court date, I have moved to a new house, when it says permitted travel expenses is this from the address on the claim or my new home address. There is a 200 mile difference now.

    Also can I claim for my Ley Rep?

    You should have asked during this process, around the time it was allocated to this court, for the hearing to be vacated and the case reallocated near you.

    It is still OK as I have planned to visit my parents and one of them is going to be my Ley Rep, this is the address on the claim. Plus my job takes me up and down passed my old family home.

    OK, so really you can only claim from your parents' home.

    You could only reclaim your Lay rep costs if you show UNREASONABLE CONDUCT.

    Search the forum for shining example unreasonableness or shining example costs and read the great example by a poster starting with the letter J, as they got over £700 in costs granted as they showed the Judge the case met that high bar. This is a real task to achieve but, a paid one, if it works!

    Might have dropped the ball a little on this one.

    Do I need to include my Defence Statement in the bundle.

    THE COURT DIRECTS:

    1 Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ ] [14 days before the hearing]. (These should include the letter making the claim and the reply.)

    I did notice that the Claimant didn't include the Claim Form N1SDT in their bundle. Am I getting myself worked up over nothing or do I need to make a trip to Court. Surly the Claim & Defence is already submitted..

    Both the court and the claimant already have copies of the claim form and your defence. You are not expected to send them another copy.

    Do take a copy of each to the hearing for your reference.
  • Your bundle should basically include everything pre-action and after court proceedings were started that you might get wish to refer to *simples*
