Is this a POPLA appeal? If so, refer to the NEWBIE section post # 3 for guidance on how to structure your appeal. I am confused when you say it is "following your first appeal."0

Yes this is the popla appeal following the 'first' appeal as it were, to the operator.
I have used the newbies section and the links to appeals by other posters on my thread that others have referred me to. I drafted this following a look at those appeals and decided to draft a longer appeal including the 6 or so points that I now have (initially it was short only using two points). I also did look at other posts and noted a recent one saying best not to make it look completely like the templates as it was noted by popla, So I have catered this to my own case of course. It'd be great if someone could go through to ensure it is accurate and advise if anything should be taken out. Much appreciated.0 -
I only skim read it, but it looks fine as long as at no point have you accidentally said who parked/paid (nothing that implies the appellant was driving), and providing that in the first appeal, you didn't choose 'driver' in their drop down menu on their appeals page.
As long as you are safe with that, you will win, as a late NTK is fatal for keeper liability.
However, I like to tie them right up, just in case:
I would add to your point about the minor keying/keypad machine error, reminding POPLA that a minor VRN difference where the vehicle is still easily identified so that the payment sets it apart from any other vehicle in the car park, is a breach of the BPA CoP, given the clear instructions to all operators in 2018 NOT to pursue charges like this against paying motorists:

In my point 1. have referred in third person actions of the driver and intentions of parking there and why. This is ok I presume? If you could possibly look at 1. and 4. referring to signs to see if its not that I've done this in third person only. Many thanks.0 -

Albeit, if you are saying it was a small keypad error then you should be pointing POPLA to their own annual report 2018 which has a section on 'keying errors' and the fact the BPA instructed PPCs to cancel or not issue PCNs at all, in such cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I had the time but I also had the resources on here and your help and therefore very grateful. It took a while for them to come back and I had seven good arguments but they fell at the first hurdle of not delivering it in 14 days so the appeal body did not need to consider the other points.
