In theory it's trespass yes.
Trespass is NOT a crime.
You would not 'NEED' to have it emptied; you may choose to, but that is largely irrelevant.0 -

A cess pit/septic tank, if working correctly doesnt need emptying every year0 -
So the buyer gets the benefit of having a nearly clean cesspit which you had to pay for. Live with it and move on.0

Well, were I the vendor, I would have refused.
Even on a yearly emptying schedule there was 33% of use left on it.0 -

You have an arrangement that has obviously worked for a number of years and I imagine you are on a route that they do.
You didn't have to remember it was very simple all done for you and now you want to throw your toys out the pram because they came a few weeks early.
If the question comes up when you sell you tell the buyer it was done in February.

I wouldn't say Im looking for a fight. But If I turned up at a clients house a month early for our 'usual' apt and said I'm here now lets get on with it, the client would have every right to say, er no! You're a month early and we haven't arranged anything, please contact me in advance to schedule a date.0
