I believe I haven't received a NTK although the internal appeal rejection letter looked very much like a NTK. Shame I can't post a link here. I showed the people over at pepipoo.com and they said that it didn't quite look like a NTK. So now, my only concerns are if that was actually a NTK and I've got nothing up my sleeve.
Also, the letter stated that after 35 they would begin the debt recovery process, it's been over 35 days and I'm not sure if that means that they are going to send baliffs to my house or if there are more stages before that.0 -
they would need a court order to send a bailiff, so definitely not going to happen
and debt recovery are debt collectors who are powerless and cannot come a knocking , see post #4 of the NEWBIES thread
you have to be taken to court , lose , and not pay up in FULL within one month before any bailiff can be tasked with the court order
no court order = no bailiffs0 -
Yeah sounds about right, it was just that on the appeal rejection letter, they said that they would start debt recovery procedures, although not baliffs, if they turned up and someone other than me opened the door, they would be quite intimidated by them and I don't want that happening.0

nobody does, which is why they need a court order first, in which case it would be bailiffs, not debt recovery0

To completely put your mind at rest that they can't hold you liable as keeper, email the DVLA subject.access email (Google or search this forum for it) and ask them to show you all details and dates of where any private parking firm or agent of same, accessed you data in that year.
You will see the PPC never did!
And so, even if they tried to say the rejection letter was a NTK (unlikely!) it is still not possible for them to use the POFA to hold you liable. Schedule 4 says the keeper's data MUST have been accessed from the DVLA (not from an appellant or any other source).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for all the information, this is my first case and I appreciate all the help.
So now I wait for a LBC until I do further action, I have requested the information from DVLA, so looking forward to that information soon. I doubt they did use DVLA because in the appeal rejection letter, they didn't use my full name, only my first and last name which I provided in the initial internal appeal. Whereas they would've included my middle name if they did request my information.0 -

OK, but for clarity, I'd be emailing the DVLA subject.access email to ask!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yep, have done it. How long do they take to reply, it says up to a month, does it actually take a month?0

Alright, so I got the letter from DVLA today and it seems like NSL hasn't requested for my details, that means they haven't followed the POFA right?
So whats my next move?0 -
Amazed how many people get a thread full of advice then ask again, what to do next.
I already told you:Coupon-mad wrote: »Not sure NSL will do court, so don't hold your breath!
If there was no NTK posted, then you can't be held liable unless you tell them who was driving, so don't do that, of course.
The only reason to contact NSL now (except if you get a LBC or court claim) is if you move house within 6 years, as you must keep your address up to date to make sure you don't run the risk of not seeing a sneaky court claim years later.I got the letter from DVLA today and it seems like NSL hasn't requested for my details, that means they haven't followed the POFA right? To completely put your mind at rest that they can't hold you liable as keeper, email the DVLA subject.access email (Google or search this forum for it) and ask them to show you all details and dates of where any private parking firm or agent of same, accessed you data in that year.
