  • Thanks (again) all. There is one added complication to this, in that from end of March onward the people involved are not going to be in the UK for an eight-week period, which could cause them to miss any posted communication.

    Any constructive comments? - I really I mean, is this likely to get dismissed before end of March?

    I'm going to post draft versions of comms to CEL, the local MP and the CEO of Sainsburys. Again, any constructive edits etc would be appreciated.

This includes "the maximum additional costs you may seek to recover," which is not included in the PCN you have sent, as your subsequent threatening communications mentioning higher figures and aggressively stating “If this matter remains unresolved costs are simply going to escalate.”

    IS THE ABOVE RELEVANT? Could it help in getting this thrown out?

    Anyway, here it is as it stands at the moment . . .

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, Sir xxxxxxx xxxxx MP.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - schedule 4 paragraph 7 of the PoFA stipulates the mandatory set of information that must be included on the parking notice. This includes "the maximum additional costs you may seek to recover," which is not included in the PCN you have sent, as your subsequent threatening communications mentioning higher figures and aggressively stating “If this matter remains unresolved costs are simply going to escalate.”

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

    - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

  • Taking previous comments about anonymity into account, it's pretty difficult to post the emails to the CEO of Sainsburys and our MP and keep it anonymous. Bit confused how to post that; basically I've adapted suggested emails from on here.

    Did anyone say keep it anonymous?

    When writing to your MP or Sainsburys you say things like "we went shopping", "we parked the car", "we spent a fortune in your shop", "we would like you to support Sir Greg Knight's Bill currently progressing through Parliament", etc.

    Surely you can write a letter without telling anybody who was driving.

    hahaha. Thanks for the response and your confidence in my letter-writing capability; I said I was confused. What I meant is that I was going to post a draft for comment, before sending. Ovs the actual letter would not be anonymous, but it should be on here:

    I was wondering if you had any joy with Sainsburys? I emailed their CEO and got a reply from one of his staff basically saying it's not their car park and they won't be able to help.
