I think this is the way to get my post back on the first page by updating. I need to send my POPLA appeal in , I have sent off for my SAR but it obviously won't arrive in time, my TOTAL over stay was 14 minutes and 99% certain neither side of the PDT - when i get a copy of it will be more than 10 minutes. I will be away again for 4 weeks from Tuesday (tomorrow) night - will they reply by post or email. If its email its ok - but if its mail I will have to arrange someone to check for me.

Yes it's fine but did you embed the image I showed you of the sign with the word penalty on it?! I know it's probably an old image but don't let that put you off, include it! Put it into your unclear signage argument and don't mention how you got it. Just include it and talk about how this sign impersonates authority with the word 'penalty' which is a significant breach of the BPA CoP and the signs are not how ECP show them to be.

And this is fine too if you add the bit in red and break it into 3 readable paragraphs:

Goulden Street, Manchester carpark is very small, there are only about 30 spaces. The spaces are very tight and awkward, there was only a couple of spaces available to the driver on the day, none if which were easy to negotiate. After waiting for another driver to leave, the driver took several attempts to park due to the awkwardness off the available space.

The Entry and exit times quoted by ECP say the car was there for 4hrs and 14 min and only 4hrs was paid for. The times are from entry and exit and not for paid parking ticket, time is always needed to park and to exit this car park due to the small space.

Because ECP fail to state on their NTK the true 'period of parking' (data which they have from the PDT machine) I have had to ask them for a Subject Access Request to see how the 14 minutes is split and because this will take a few weeks to come back, I am having to guess for the purposes of this POPLA appeal. What I will say is, if the total stay is purportedly 4 hours plus 14 minutes, then it is likely that the reasonable time at the start to find a space as described above, before being able to park and pay at the machine, accounts for at least 5 minutes of the 14 (maybe more) and thus the grace period at the end cannot be over the MINIMUM of ten minutes an AOS member parking firm must allow after expiry of paid-for time. Thus, the PCN was not properly given.

A massive thank you, I have now updated and checked with a fine tooth comb all the advice you have given me and updated the appeal as suggested. I went throughout the popla appeal in newbie 3, step by step, added my PDF and have now got confirmation and password. I will wait for the SAR to come back and hopefully that will show that it was less than 10 mins either side. It has been quite stressful for someone like me and not sure I would have got to this without the support of these pages. ( even though i know as scum bags they should never be paid).. Cant wait for the law to change completely. Thank you so much, I'm keeping my fingers crossed now to see what they will say. Please have a virtual White wine spritzer on me. I 'll let you know results as soon as I do. Last questions do they email me or do i have to keep checking the site.... and is there an average time they take ??
