the next part is the DQ which you would know if you study the NEWBIES thread and the posts by members BARGEPOLE and LOC123
once you have filled that in and submitted it (by email if you like to the CCBC and is also sent to the claimant), your local court will be allocated
once that is done , the claimant will have a deadline date to pay a court filing fee in order to progress it
so due to those unknown timeframes, nobody can answer your question0 -
Hello Redx and everyone
DQ is filed. After an hour looking for the answer online I've found it on the notification letter: Green Parking has 28 days from receiving the defence doc to pay the next fee and move the claim forward. So 23 April is the deadline. Fingers crossed!0 -
Green Parking has emailed the court system to say that they intend to prosecute, about a week ago, but no further movement. Does anyone know if this is enough to prevent the case being stayed?
Oh, and we have also received a court notification re the big claim.
Starting to think about a defence bundle, and constructing a defence for the second claim. The new defence will be the same as the old, but with some added information regarding data protection misuse and late notifications.0 -
No they have not emailed the court to say they intend to prosecute that is completely untrue.....0

Hi Shedheadgirl. You mentioned in an earlier post ( back in Feb I think ) about advice from a solicitor regarding new signs in the car park, suggesting that the old signs were inadequate or they wouldn't have needed to install new signs, well I have just won a case in March for exactly that reason. Fortunately I had photos of the before and after signs and the DJ studied them then dismissed the case, saying that the original signs were unclear.
Your Daughter did nothing wrong, she just visited her boyfriend, that it not a reason to have your life turned upside down, it took me 11 months to fight my case, the sheer anger drove me on. I had paid the full fee and did nothing more than only enter a partial VRN, which still identified my car. Best wishes and good luck.0 -
@Brown Trout
Have probably used incorrect terminology but the intention is most certainly correct:
To: CCBA AQ
From: QDES Defended Team
Subject: Intention to proceed
We act for the claimant...
Please note our intention to proceed with this claim.
They had until 22 April to avoid a stay. The email was supposedly sent on 10 April.
I see moneyclaim has now been updated to say that a DQ has been sent. Presume this is the next stage, have been trying to see what a DQ means/is. Any advice please?0 -
@PJR1525 Your situation and my daughter's are not quite the same, but really happy for you that yours was sorted!0

The DQ (Directions Questionnaire) is explained fully (along with the suggested method of filling it in) in the NEWBIE post #2 where is explained by Bargepole - what happens when.ShedHeadgirl wrote: »I see moneyclaim has now been updated to say that a DQ has been sent. Hi ShedHead Girl,
Have you requested a copy of the contract between the Claimant and Landowner?
My case was won just yesterday against UKPC. They issued multiple tickets against me, and the contract they produced didn’t actually clearly show they had the right to operate on the land on the required dates. The Judge dismissed the case before our evidence was even heard.
Keep going, and don’t give up. The advice on here is brilliant, and will guide you through. This was all totally new to me, and if I can win against these cowboys, then so can you!0
