Hi ShedHead Girl,
Have you requested a copy of the contract between the Claimant and Landowner?
My case was won just yesterday against UKPC. They issued multiple tickets against me, and the contract they produced didn’t actually clearly show they had the right to operate on the land on the required dates. The Judge dismissed the case before our evidence was even heard.
Keep going, and don’t give up. The advice on here is brilliant, and will guide you through. This was all totally new to me, and if I can win against these cowboys, then so can you!0 -

Wow. They have deleted all records, and yet they still have her name, address, records of the charges etc and most importantly are the named company taking her to court. Oh, and an email is apparently not a written record,
Obviously we will follow up with ZZPS, and we will send a response to the DPO. Anything else we should be doing?
What complete and utter rubbish respond with I don't believe & make sure you copy in the ICO, and make sure you make it obvious you want the ICO to investigate
They will need to have copies of the invoices for accounting purposes, you have to keep them for six years
Trust me Email is a written recordPrivate Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA

Brilliant, am so pleased for you. I am hoping that Green Parking are burying themselves ever further in the mire. As a matter of interest, how did you get hold of the contract? Part of our defence is around the fact that we suspect that Green Parking does not have jurisdiction over the whole car park.0 -
You get to see the contract in their evidence before the hearing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have pointed out to the ICO that they havent actually said that they will send the information requested. Hadnt thought about retaining the invoices..good point. Am agreed that an email is written (and somewhat ironically they were responding to the ICO on email) And the grammar errors, ouch.0 -
They don't sound the brightest bunch.
Push the ICO about this as the parking firm remain the 'data controller' at all times and they MUST be lying about not having any data. They cannot just pass the data entirely to a third party and pretend they hold nothing. THEY are the data controller.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Re being the data controller, t:his was pretty much my thought too, seems like they may not have had the GDPR training my organisation forced us to sit through....:(
We have sent an SAR request to ZPSS, will be interesting to see what response we get. And who turns up in court if we get that far...0 -
A quick update: we have a court date for the initial claim, and the defence bundle is going in today. Wish us luck!0

Show us the bundle then! Witness statement, evidence AND your costs schedule.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
