    Thank you Le Kirk, done, with some detail around why I am unhappy. I have also reported them to the DVLA given that they claim to be in partnership with them.

    Brilliant, am so pleased for you. I am hoping that Green Parking are burying themselves ever further in the mire. As a matter of interest, how did you get hold of the contract? Part of our defence is around the fact that we suspect that Green Parking does not have jurisdiction over the whole car park.

    They will need to have copies of the invoices for accounting purposes, you have to keep them for six years

    Trust me Email is a written record

    I have pointed out to the ICO that they havent actually said that they will send the information requested. Hadnt thought about retaining the invoices..good point. Am agreed that an email is written (and somewhat ironically they were responding to the ICO on email) And the grammar errors, ouch.

    Push the ICO about this as the parking firm remain the 'data controller' at all times and they MUST be lying about not having any data. They cannot just pass the data entirely to a third party and pretend they hold nothing. THEY are the data controller.

    Re being the data controller, t:his was pretty much my thought too, seems like they may not have had the GDPR training my organisation forced us to sit through....:(
    We have sent an SAR request to ZPSS, will be interesting to see what response we get. And who turns up in court if we get that far...
  • A quick update: we have a court date for the initial claim, and the defence bundle is going in today. Wish us luck!

  • So...we won the smaller case. Two main areas of defence, the first being around whether a contract existed, the second being whether Green Parking followed due process; the judge declined to rule on the first, but the case for the second was overwhelming. We have now also had a letter from QDR to advise that the larger case is being withdrawn. Thank goodness!

    I still cant quite believe it and am totally and utterly in debt to you guys, your help and guidance was brilliant, generously given, and spot on. Thank you so much xxxxx

    And so ends a truly scary episode for me and of course for my daughter. She's learned a huge lesson around where she parks and how much she should trust what others say, particularly "Don't worry, I'll sort it" if there is any kind of liability involved.
