I have asked NCP if they obtained my details through PoFA and awaiting response. Now I just need to try and access the commercial land registry that I have been granted access to but the file is too big to open on Excel :mad:. I've requested the FOI through the council with regards to the lease but they have 20 days to reply.
For arguments sake...
IF NCP don't have lease title, and have accessed my details through PoFA for contravention on public land, they will have used the information provided to them from the DVLA (They requested it detailing contravention on private land and not public land as the case is) to claim against me which I think would be a misuse of the information as they have no legal right to sue me and only the driver?0 -
Royal Mail must be the absolute worse at delivering legal papaerwork.
I mean.....it’s almost as if either Royal Mail deliberatly do this, or, per chance, legal paperwork just always gets lost in the system.

A PPC or landowner (and arguably, NCP might be both here) CAN get data in non-POFA cases, to ask the keeper who was driving.
There is a DVLA FOI somewhere held by Auntie Google, saying just that.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's not just legal paperwork that's not been delivered to my address and constantly receiving other people's mail too. I have complained to Royal mail about this so it is noted with them.0

They may not have any legal right to sue you (whatever that means - anyone can sue anyone else for any reason), but they do have the legal right to ask the DVLA for keeper details.
They can ask for keeper details to enable them to ask the keeper for the name of the driver.0 -

The PCN's were sent from a location a 2 hour drive from where I live (copies received from their legal representatives after I requested them upon receipt of court papers and a week after I needed to submit my defence must I add!!!!).

Perhaps he/she doesn't realise that all private PCNs are a scam, and that blaming the motorist or keeper on this forum, just isn't what we do.

It's quite upsetting to read such comments especially when I don't condone non payment of this ticket but when I have been wronged in the way of not having received these invoices, Royal mail not able to prove what did or didn't come to my address, and being pursued for £242 when I wasn't driving or even anywhere near the carpark!
These instances are stressful enough for anyone but I also have the added stress of being physically incapacitated at times restricting me in being able to do research and type anything up to defend myself. I came on here to get genuine help as I need it. Not to be judged and accused of lying too!
Rant over!
Back to drawing board tomorrow as I have made notes this evening and just need to get things straight in my mind to get my findings over to you to put me straight with.

Because I disbelieve the Amount of people that ‘never got a letter’ - and I detest being lied to, and the holier than thou nature of some of these threads.
I know better than to get embroiled into an arguement on this one - but I strongly disagree with your constant assertion that everyone is being ‘scanmed’ - they are not. Whether they are being unfairly charged/penalised or treated is another matter - but scam it is not.
It is a industry that is unregulated and sometimes guilty of trying to maximise their profits. There are also plenty of other industrys like this.
