Someone crashed into my parked car and is now claiming it was illegally parked, please help

Hi everyone

I'm just after a bit of advice.

So on Saturday at 10am I parked up my car at point A on the attached image after the double yellow lines (google maps is outdated so I had to draw in the double yellow lines). I returned to the car at 3am to find it had been involved in an accident and was now resting on a pillar on the priority chicane (point B) 10-15 yards up the road. The driver had fled the scene with her car without calling the police or leaving any details, so we reported the incident as a hit and run.

She then returned the next day at 7pm when my car was getting towed, identified herself and claimed that my car was parked at B when she stuck it. She also placed a note on my car shortly before I arrived (between 5-7pm as I have pictures from 5pm that day showing no note) saying that she struck my car as it was parked incorrectly on the chicane "blocking the route" and it was dark. Amusingly she apportions blame to me throughout the note and then signed it off with "sincere apologies". It transpires that she only returned to the scene after making a claim with her insurance. She also refused to provide any details aside from her name, registration, and insurance company

I am quite frankly appalled and infuriated by her shameless claims. If my car was illegally parked on the chicane and "blocking the route" how did other cars (not to mention a bus whose route involves this road) get through for 4 and half hours.

In terms of evidence, I have photos taken 20 minutes after the accident (when I first returned to my car) which clearly show a trail of debris starting from A leading up to B and photos showing the numerous street lights on the road.

I have made a claim with my insurance but fear this is something that will drag on, could you guys please advise as to anything further I can do.

    No diagram attached as it is your 1st post with this account.
    Perhaps the underwriters may split the liability as that maybe the most cost effective route to a closure.

    It matters not that you were 'illegally' parked. The bottom line is that they hit a stationary object and therefore the at fault party.

    If they misjudged the gap or similar then that just brings into question their fitness to be in control of a vehicle.

    It's hard to see how anyone who hits a stationary object can be less than 100% to blame.


    Even if a car is blocking the road, that is no excuse.


    If I were the Op I'd also report the TP to the police for refusing to give her address.

    It doesn't no, however it looks from the diagram that the OP was more or less parked at a corner, judging by the placement of the vans, it appears around there people park without consideration of other road users, that said, a question ….was the car parked opposing the flow of traffic?

    Insurance claims (both disputed and undisputed) always take a long time to be concluded - certainly months rather than weeks.

    But if you have claimed against your own policy then the repairs should be dealt with quickly.

    Make sure your insurer is aware of the facts and leave it to them to resolve

    Nope the car was parked in line with the flow of traffic. It was hit front on by the TP and pushed 15 yards to the priority chicane,

    With regards to the corner, the TP point of contention is that I was parked onto the green verge of the parking chicane blocking the road.

    Sadly the car, in my opinion and that of the tow truck driver, been written off. There was extensive damage to the front of the car.

    Repaired/written off should make no difference as far as a claim against your own policy takes in terms of getting a settlement

    Keep all your receipts/tickets etc for all your uninsured losses do that you can reclaim them from the third party along with hire car costs, your excess etc in the event it's concluded as the third parties liability
