Do I have any rights if I accepted a goodwill gesture?

    As I have already stated.


    Where did I say I was entitled to anything more? All I asked was if I should have accepted the goodwill gesture or was I entitled to more (ie the full costs incurred). This has been answered in regards to the company I then asked a simple question in regards to insurance. All you and others had to say was you didn't know.

    Seriously if I was after some huge payout I would not have accepted £50 in the first place.

    This is the last time I will be asking for advice on what I thought was a legitimate and respectable forum.


    In your opening post you certainly say that you feel you are entitled to more than your out of pocket expenses:


    I accepted this as I was really only bothered about the cost of the phone calls, but I am now regretting this as I feel this does not truly compensate for the stress and fear I was put under.

    So how much do you think that's worth as a goodwill payment if it's not covered by insurance (which is highly unlikely)?

    I'm guessing you travelled by yourself. So even with a hotel room would you not have the stress and fear of being alone in a strange country?

    Its been some years since I've been to turkey but oct-mar I think (around those times anyway) was always their "off season". Most places would shut down and those employed there during summer would then get jobs in construction building new hotels etc.

    You should get your actual losses reimbursed by them along with what has been said above - if the new hotel was of a lesser standard/made you incur additional costs (perhaps if it was a considerable distance from the old one).

    As for stress and fear....why would you feel fear? I get that you were travelling alone in an unknown country but you would've been travelling alone in an unknown country whether they had breached the contract or not. Likewise both travelling and breach of contract are naturally stressful situations. It may have caused some additional stress but from what you've said, this was sorted in a few hours and you haven't said anything to indicate it had any sort of lasting impact on your holiday.

    By all means work out what your holiday was worth per hour, how long you actually lost (when you would have arrived at original hotel compared to when you actually did arrive at the new one) and then ask them for that figure (imo it sounds like they've been negligent and its not a case of circumstances outside of their control). But you need to be able to show what losses you actually incurred due to their breach.

    Lastly, this is all assuming you didn't accept their offer in full & final settlement.

    Far too many 'what ifs' that didn't happen. Just chill, put what did happen out your mind and enjoy your holiday.

    Yes I regularly travel by myself but I always know where I am going, where I am need to go for transport, where my hotel is beforehand. This was a situation I had never been in.
