  • hi been reading posts and they have been useful. i've just some questions of my own.

    We are leaving our mortaged house and moving into rented in Jan hopefully, we have got the house sorted and are handing our keys back. but i'm confused of what to do next.

    1. once moved into rented do i have to arrange a court date for BR and then fill forms in or fill forms in take to county court and then ask for court date?

    2. do i have to let my mortage company know i've left the house and intend not to pay anymore mortage payments?

    3 . i'm still in my mortaged house now shall i be completing the forms now on line.

    i know they sound like really simple questions, i just don't know what to do in what order?

    Hi NG, welcome along Hun.....it may be worth you starting your own thread & let us know the `bigger picture`

    Have you spoken to one of the debt charities to ensure BR is the best route. Vol repo does`nt always lead to bankruptcy.

  • we've got a lot more debt than just the house and going BR is the best option for us. I've spoke to two of debt charties and CCCS weren't really that helpful to be honest and i know a lot of people have recommeneded them and i'm waiting to hear from National Debt Helpline. I've consulted a solicitor and spoke to a financial advisor and they've agreed they think i'm doing the right thing. I'm just confused as to the steps to take after moving out of our mortgaged property to rented.

    Finally I have something to report!

    Potless and I have received our individual letters/reports re our BRUs - I won't bore you with all the ins and outs (to be honest, they didn't make very pleasant reading) and the short story is he's been given a 3 yr 6 month BRU (would have been 4 years if been a BRO) and I've been given 4 years (reduced from 5 for accepting the BRU). Ever so slightly stunned that I was given longer than him when he ran up a LOT more individual debt than me but I'm not dwelling on it (much). They were both for "obtaining credit with no reasonable prospect of payment" with H having the additional "and using those funds for the purposes of gambling".

    I do actually feel like we've both been treated quite harshly - I still don't think that we acted any differently to most people who go BR (with the exception of H's poker of course) and I think it's unfair that they've said (in the reports) that we should have realised we were "cash insolvent" back in Jan. 2007. I haven't got the strength to fight them on this though unfortunately - I couldn't cope with going to court etc... to argue my case, so we're just going to accept it, count down the weeks now to AD and try and get on with our lives.

    I suppose at least you know now so like you say you can wait for AD and get on with things.

    What a bummer Scarlett.
    That is very harsh giving you more than him, I'm shocked TBH.

    I really don't get that 'obtaining credit with no reasonable prospect of paying' bit, surely that could apply to all of us :confused: if we all had crystal balls we'd not be BR.
