    I have a couple of questions re BRUs and wondering if anyone could answer them. I've searched the IS site and can't find the answers (have also emailed them but not expecting a reply over the weekend now):

    1. Does a BRU extend the time-frame within which an IPA can be issued? I know that in normal bankruptcies an IPA needs to be in place before the bankrupt is discharged and can not be implemented afterwards - is this the same for a bankrupt with a BRU or can an IPA be implemented during the term of the BRU?no

    2. Does the term of the BRU extend the time that the bankrupt's status is shown on their credit file? For example - if the BRU was 5 years, then is this 5 years added to the original 6 that the bankruptcy status shows on the credit file? So, would it be: 1 year for the term of the bankruptcy + 5 years (to total 6) then + the 5 year BRU term? yes

    That’s the point of a BRU to protect creditors from an addiction, but more importantly it is to protect you against your own addiction (well your OH) Its not always a punishment really, it is meant to help

    although some may argue, i actually see it as a help where gambling is a factor, or drugs for that matter because both are an addiction, but some would argue that it may drive some to crime to feed there habit which I also acknowledge

    Tough one really but hopefully doesn’t apply, it sounds like your OH has learnt his lesson so to speak

    No - you are still discharged at the normal time, so credit wise it's still the same..... it is, but not quite as you will have banking/credit restrictions extended for the term of any BRU

    and No again, the IPA still has to be put in place prior to discharge.

    dont forget, your name and details will be online on the London Gazette for ever....beyond your death......for eternity, unless a black hole experiment goes wrong (or right, however you look at it) the LG site is also open access/public domain....

    So, to confirm...... (sorry to be a thicko) regarding our credit files - our BR status will show on those for the usual 6 years PLUS whatever the term of our BRUs? So, re. any chance of a mortgage in the future - we're talking 11 years+ (for Potless anyway). Gosh...... :-(

  • Whilst I'm sorry your BR is being extended, its probably best you don't go into a mortgage anytime soon as the underlying issues need to be sorted.

    I can assure you that ALL underyling issues have been 100% sorted now. As I've mentioned before. H was never a gambling addict in the "traditional" sense of the term. He genuinely thought that a living could be made from playing online poker (people really do, you'd be amazed. Obviously a lot more don't suceed than do) and he never 'enjoyed' it or got a 'buzz' from it....... the pressure to pay the mortgage got in the way of any enjoyment.

    He tried. He failed. We made mistakes. We moved on. End of.

    Regarding a mortgage - well, it's not something that could even be considered at the moment anyway, with him not working, so it doesn't really matter. But I do have to say - I don't think 11 years is "anytime soon" really, do you? <smile>
