I find it hard to believe that any decent employer would take this angle. You can have two apparently identical jobs, one you love, and one that makes you feel ill every day.

The difference could be who you sit beside. They might be a racist/homophobe, you sit there listening to their !!!! while your line manager laughs along with them.

My point being that most employers will just pay what they have to rather than go looking for trouble. Its impossible for them to say they shouldn't have paid you just because you then go on to get another job that doesn't make you feel ill.
I had no idea you could go on the sick and be paid sick pay cos one hates a job they are in...are you sure that is the case?

You would need a fit note from your doctor (the old sick note).
Unless you are being paid contractual sick pay, you would receive statutory sick pay (which isn't a lot) as long as you met the eligibility requirements (google for those)

Not simply for hating a job or half the country would be on the sick:) However, if the situation gets so bad that it is affecting your mental health then you can be 'signed off' by your GP.

If it is causing you health problems as a result, absolutely.
