  • Sorry to act thick but what does that mean ‘accruing’?
I have not taken a lot of holiday with this job. I had to use up 20 hours in December before jan when it reset. And then I’ve just booked 3 days off in Feb and 3 days in July for the rest of the year and that’s it. Sorry just trying to understand it!

If you do leave how will you answer at interview if asked about the reason for leaving your previous job?
What answer will you give to questions about sickness / absences?

You are entitled to a minimum of 5.6 weeks holiday a year, if you leave half way through the holiday year you will have accrued half of that amount.
If you left today you would be entitled to roughly 1/12th of your holidays and would be paid for them (minus any already taken) in your final pay packet, if you stayed on the sick and left employment in say 5 months then you would have accrued approx half of the entitlement.

If you leave your job for another job whilst being on the sick then your employer could dispute that your illness was genuine and could refuse to pay you the SSP.

I find it hard to believe that any decent employer would take this angle. You can have two apparently identical jobs, one you love, and one that makes you feel ill every day.

The difference could be who you sit beside. They might be a racist/homophobe, you sit there listening to their !!!! while your line manager laughs along with them.

My point being that most employers will just pay what they have to rather than go looking for trouble. Its impossible for them to say they shouldn't have paid you just because you then go on to get another job that doesn't make you feel ill.

Agreed but with something like anxiety or depression it would be more difficult to prove it to be a false claim. On the other hand if somebody had claimed to be unable to move but had managed to attend interviews and get another job whilst off sick it would be a comparatively easy route to take.
